In order to preserve a decreed conditional water right, the
owner must obtain a fmding of reasonable diligence from the
water court every six years or the conditional water right is
abandoned.

4. Surface vs, Ground Water Rights
· All surface water is tributary and aClministered under the priority
system.
· All ground water in the state is presumed to be tributary.
i. Ground water wbich is tributary to a surface stream is
administered as part of the priority system.
· Non-tributary ground water is not subject to appropriation; rather it is
allocated according to land ownership.

Water Right Ratification Process

1. Water Divisions

· The state is divided into seven water divisions:
Division 1 - South Platte River Basin
DivisiOn 2 - Arkansas River Basin
Division 3 - Rio Grande River Basin
Division 4 - Gunnison River Basin
Division 5 - Colorado River Basin
Division 6 - White River and Yampa River Basins
Division 7 - San Juan River Basin

· Each division has a water court located as follows:
Division 1 - Greeley
Division 2 - Pueblo
Division 3 - AIamosa
Division 4 - Montrose
Division 5 - Glenwood Springs
Divismn6-S~boMS~~
Division 7 - Durango

2. Adjudication is accomplished by the following process:

· An application is filed with the water court;
· The water court publishes the application in local newspapers and in the
"resume";
