Re-operation will not diminish the ability of agricultural users to store <br />water in Project facilities under the Winter Water Storage decree. <br /> <br />. Re-operation will not reduce the flow of the Arkansas River below Pueblo <br />Dam below 100 cfs. <br /> <br />. No injury, as defined under Colorado Water Law, will occur to existing <br />water rights due to re-operation of Proj ect storage space. <br /> <br />The following paragraphs highlight key assumptions used in the model to <br />maintain the integrity of Project operations and protect existing beneficiaries of <br />the Fry-Ark Project. <br /> <br />USBR Contracts <br /> <br />A contract between the District and the USBR was signed on October 23,1981 <br />for repayment of the District's share of the reimbursable cost for project <br />construction. The project has been operated historically to generate revenues <br />from water sales so that the repayment contract can be fulfilled. "''oJ_,...__...... <br />of active Project storage, 159,000 af is municipal carryover space for Project <br />water. The remaining 146,325 af is unallocated Project storage. Non-Project <br />water can be stored in the Project space but must be spilled to accommodate <br />Project water. Under Re-operation Scenario B, the re-operation storage identified <br />to be available by the operations model (48,500 af) would essentially become <br />long-term contract space, available to an entity contractingJor that space. The <br />entity could use its share of the space to store non-Project water. <br /> <br />Project Spill Priorities <br /> <br />Amendment No.4 of the District's Contract with the USSR governs the priority <br />of reservoir spills. Water is evacuated from the project reservoirs in the following <br />order: <br /> <br />I. Water stored under "if-and-when" contracts for entities which will use the <br />water outside of the District boundaries; <br /> <br />2.
