<br />(2) Such assessment shall not exceed five mills on each <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />42 <br /> <br />herein provided, made applicable and are to be fOllOwed in <br />the levy of assessments for payment of taxes and collection <br />of principal and interest on such general obligations. (1937). <br /> <br />l50-7-23. Lawful contracts. - (1) (a) When the petition <br />for the. organization of a subdistrict and the decree for such <br />organization so provides it shall be lawful for any said sub- <br />district to make contracts as follows: <br /> <br />(b) A water users' association may bind itself to levy an <br />annual assessment for the use of water and to secure same by <br />liens on land and water rights or in such manner as may be <br />provided by law. <br /> <br />(c) Any person or corporation landowner may create a <br />mortgage lien upon lands or give other security satisfactory <br />to the board or any other contracting agency, and all such <br />contracts shall provide for forfeiture of the use of water <br />for nonpayment of assessments or installments in the same <br />manner and procedure as provided by statute for forfeiture <br />of stock in a mutual ditch company. (l937). <br /> <br />150-7-24. Maintenance assessment. - (l) To maintain, <br />operate and preserve ditches, canals, reservoirs, or other <br />improvements made pursuant to this article, and to strengthen, <br />repair and restore the same, when needed, and for the purpose <br />of defraying any incidental expenses of the subdistrict, upon <br />completion of a works provided for in the plan for any such <br />subdistrict, on or before the first Monday in November of <br />each year thereafter, the board of directors may certify to <br />the board of county commissioners of the county in which <br />said subdistrict or any part thereof is located an assess- <br />ment on each tract of land and upon public -corporations subject <br />to assessment under this article, for the purpose of raising <br />funds to be used for the maintenance of said improvements. <br />If an appraisal of benefits has been made against the lands <br />in said district, assessments shall be apportioned by the <br />county treasurer and by the board of directors of said dis- <br />trict against the property therein upon the basis of the <br />appraisal of benefits originally made. If no such app~aisal <br />has been made and the form of organization and financing is <br />such that revenue warrants or general obligations of the sub- <br />district have been issued, then said assessment shall be made <br />on the basis of assessed valuation of the property subject to <br />assessment in said subdistrict. <br />
