<br />;;. <br /> <br />PlJ <br /> <br />'f <br /> <br /> <br />CONTRACf <br /> <br />THIS CONTRACT, made this 1!! day of September 1993, by and between the State of Colorado for the use and benefit of the Department of <br />Natural Resources. Colorado Water Conservation Board. 1313 Sherman St Room 721, Denver, Colorado 80203 hereinafter referred to as the State. and Town <br />of Su~ar Gtv. P.O. Box 69, Su~ar City. CoJorado 81076, hereinafter referred to as the Contractor. - <br /> <br />WHEREAS. authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered <br />balance there of remains available for payment in Agency PDk Fu~d NUmber 424. Organization 92YY. Appropriation Code 100, Program WTRC, Object Code <br />5110. Sub Object Code 24, Coutract Encumbrance NumberC/53(, <:6' ; and <br /> <br />WHEREAS, required approval. clearance and coordination has been accomplished from and with appropriate agencies; and <br /> <br />WHEREAS. the State desires to assist public agencies, established under Colorado law. for the purpose of a pilot program demonstrating the <br />benefits of water efficiency measures by providing incentive grants pursuant to the authority granted in Section 37-60-125, CRS; and <br /> <br />WHEREAS. the Contractor's application for a granl-from the Water Conservation Board Construction Fund has been received and approved by <br />the Colorado Water Conservation Board; and <br /> <br />WHEREAS. the CoJorado Water Conservation Board desires to distribute said funds pursuant to Jaw; and <br /> <br />WHEREAS. the Contractor is an eligible public: a.qency to rec_~ive lUaJtt assistance from the Pilot Program foc demonstrating the benefits of water <br />efficiency measures. <br /> <br />NOW THEREFORE it is bereby agreed that: <br /> <br />1. Area Covered. The Contractor shalI perform and accomplish aU the necessary work and services provided under this Contract, as described <br />in the attached Exhibit A. which is incorporated herein and made part of this Contract by reference. <br /> <br />2. SeoDe of Services. In consideration for the monies to be received from the State. the Contractoc shaU do, perform, and carry out. in a <br />satisfactory and proper manner, as determined by the State, aU work elements as indicated in the "Scope of Services", set forth in the attached Exhibit A. <br />hereinafter referred to as the "Project" and inCOl'JX>rated herein. Work performed prior to the exerotion of this Contract shall not be considered part of this Project. <br /> <br />3. ResrxmsibJe Administrator. The performance of the services required hereunder shall be under the direct supervision of Jack Nichols. an <br />empJoyee or agent of Contractor. who is hereby designated as the administrator-in-charge of this Project. If At any time the administrator-in-charge changes the <br />Board must be given written notice of the change and must approve the replacement before any further monies are distributed. <br /> <br />4. Time of Performance. This Contract shall become effective upon proper execution of this Contract by the State Controller or his designee. <br />The Project contemplated herein shall commence as soon as practicable after the execution of this Contract and shaU be undertaken and performed in the sequence <br />set forth in the "Time of Performance" in the attached Exhibit A. Expenses incurred by the Contractor in association with said Project prior to execution of this <br />Contract shall not be eligible expenditures. The Contractor agrees that time is of the essence in the performance of its obligations under this Contract, and that <br />completion of the Project shan occur no later than the termination date set forth in the Time of Performance in Exhibit A. <br /> <br />5. COI1lDensation and Method of Payment. The State agrees to pay to the Contractor, in consideration for the work and services to be performed, <br />a total amount not to exceed ONE THOUSAND AND SIX HUNDRED AND 1WENTY SIX AND 881100 DoUars ( $1,626). The method and time of payment <br />shaH be made in accordance with the "Payment Schedule" set forth in Exhibit A. <br /> <br />Page 1 of 6 pages <br />
