<br />* 39.78 <br /> <br />AURORA CODE <br /> <br />Sec. 39-78. Lawn irrigation. <br /> <br />(a) Waste. Waste of water shall not be permitted. Waste of water is defined as, by way of <br />illustration, but not limitation: continuous application of water to lawns or sod resulting in <br />ponding or the flowing of waste water into drainage or storm drainage facilities; failure to <br />repair irrigation system units which are leaking, application of water intended for lawn <br />irrigation to impervious surfaces and all other applications of water which do not result in <br />beneficial use of such water. Violators of this provision regarding waste shall be subject to the <br />enforcement provisions set forth in subsection (b) below. Notwithstanding any other provisions <br />of this section, the director of utilities or his authorized agent may shutofTwater service to any <br />given premises if the director or his authorized agent reasonably finds that an extreme waste <br />of water is occurring on the premises. <br /> <br />(b) Enforcement. The person or entity billed for water service to any given premises, <br />whether owner or occupant, shall be responsible for compliance with the aforementioned <br />conservation measures and violators of such conservation measures will be subject to the <br />following actions and penalties: <br /> <br />(1) In the event of a first violation, the person or entity billed will be advised in writing <br />of the violation and a twenty-live-dollar charge will be added to the water bill for the <br />premises. <br /> <br />(2) In the event of a second violation at the same premises, the person or entity billed will <br />be advised in writing of the violation and a fifty.dollar charge will be added to the <br />water bill for the premises. <br /> <br />(3) In the event of a third or any subsequent violation at the same premises, the person <br />or entity billed \vill be advised in writing of the violation and a one hundred.dollar <br />charge will be added to the water bill for the premises. <br /> <br />(4) In the event of a third or any subsequent violation at the same premises, the director <br />of utilities may choose to suspend service in which case the person or entity billed <br />shall post a bond with the director of utilities in the sum of one hundred fifty dollars <br />($150.00) in order to obtain restoration of service, such bond to be conditioned upon <br />compliance with the above conservation measures. Failure to comply shall result in <br />forfeiture of the bond. <br /> <br />(5) Appeals of such penalties may be made pursuant to the appeal procedure set forth in <br />section 39.88. <br /> <br />\ <br /> <br />(c) Director of utilities. The director of utilities or his assignee is hereby empowered to <br />enforce all provisions of this section. (Ord. No. 80.159, S 1, 10.27-80; Ord. No. 81.43, S 1,4-6.81; <br />Ord. Definitions. <br /> <br />For purposes of this division the following definitions shall apply: <br /> <br />Aurora water supply deliuery system shall be defined as all those systems of water delivery <br />owned, operated, and maintained by'the city and all other delivery systems which are supplied <br />water by the city. <br /> <br />Lawn, turf or sodded areas shall be defined as those areas primarily devoted to the <br />cultivation of any species of grass. <br /> <br />Supp. No. 45 <br /> <br />2760 <br />
