<br />EPARTMENT OR AGENCY NU E <br /> <br />CONTRACf ROU11NG NUMBER <br />05.3 <br /> <br />CONTRACf <br /> <br />TIllS CONTRAcr, made this 22nd day of June 1992, by and between the State of Colorado for the use and benefit of the Deoartment <br />of Natural Resources. Colorado Water Conservation Board. 1313 Sherman St. Room 'nl. Denver. Colorado 80203 hereinafter referred to as the State, <br />and the Town of Silt. P.O. Box 174. Silt. Colorado 81652. hereinafter referred to as the Contractor. <br />I <br /> <br />WHBRFAS, authority exists in the law and Funds have been budgeted, appropriated and otherwise made available and a sufficient <br />unencumbered balance there of remains available for payment in Agency PDA Fund Number ~ Organization 92YY. Appropriation Code 100, Program <br />WfR(;, Object Code 5110. Sub Object Code l!1, Contract Encumbrance Number c.. I ':J.~ (D 15 : and <br /> <br />WHBRFAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and <br /> <br />WHBRFAS, the State desires to assist public agencies, established under Colorado law, for the purpose of a pilot program demonstrating <br />the benefits of water efficiency measures by providing incentive grants pursuant to the authority granted in Section 37..w-12S, CRS; and <br /> <br />WHBRFAS, the Contractor's application for a grant from the Water Conse:rvation Board Construcdon Fund has been received and approved <br />by the Colorado Water Conservation Board; and <br /> <br />WHBRFAS, the Colorado Water Conse:rvadon Board desires to distribute said funds pursuant to law; and <br /> <br />WHEREAS, the Contractor is an eligible public agency to receive grant assistance from the Pilot Program for demonstrating the benefits <br />of water efficiency measures. <br /> <br />NOW nrnREFORE it is hereby agreed that: <br /> <br />1. Area Covered. The Contractor shall perform and accomplish alI the necessary work and services provided under this Contract, as <br />described in the attached Exhibit A. which is incorporated herein and made part of this Contract by reference. <br /> <br />2. Scone of Services. In consideration for the monies to be received from the State, the Contractor shall do, perform, and carry out, in <br />a satisfacto.ry and proper manner, as determined by the State, aU work elements as indicated in the "Scope of SelVices", set forth in the attached Exhibit <br />A, hereinafter referred to as the "Project" and incorporated herein. Work pedormed prior to the execution of this Contract shall not be considered part <br />of this Project. <br /> <br />3. Resoonsible Administrator. The performance of the services required hereunder shall be under the direct supervision of James A. Yale. <br />an employee or agent of Contractor, who is hereby designated as the administrator-in-<:harge of this Project. If At any time the administrator-in-<:harge <br />changes the Board must be given written notice of the change and must approve the replacement before any further monies are distributed. <br /> <br />4. Time of Performance. This Contract shall become effective upon proper execution of this Contract by the State Controller or his <br />designee. The Project contemplated herein shall commence as soon as practicable after the execution of this Contract and shall be undertaken and <br />performed in the sequence set forth in the "Time of Performance" in the attached Exhibit A. Expenses incurred by the Contractor in association with <br />said Project prior to execution of this Contract shall not be eligible expenditures. The Contractor agrees that time is of the essence in the performance <br />of its obligations under this Contract, and that completion of the Project shall occur no later than the termination date set forth in the Time of <br />Performance in Exhibit A. <br />5. ComDensation and Method of Pavment. The State agrees to pay to the Contractor, in consideration for the work and services to be <br />performed, a tDtal amount not to exceed FIFTEEN TIIOUSAND NINE HUNDRED FIFTEEN AND NO/lOO Dollars ( $15.915.00). The method and <br />time of payment .shalJ be made in accordance with the "Payment Schedule" set forth in Exhibit A. <br /> <br />Page 1 of 6 pages <br />
