<br />Pursuant to drder of Referral; filed and entered in the
<br />
<br />above case on May, 21, 1976, the un?ersigned Water Referee,
<br />
<br />
<br />having investigated the matter of the application on file
<br />
<br />herein, hereby makes the following findings and ruling thereon:
<br />
<br />FINDINGS OF FACT
<br />
<br />1. That the said application'was filed on May 21, 1976.
<br />
<br />2. That the Water clerk caused publication of such filing
<br />
<br />as provided by statute; that the time for filing Statements of
<br />
<br />Opposition expired on the last day of July, 1976, and that none
<br />
<br />has been filed.
<br />
<br />3. That the said application concerns a natural lake
<br />
<br />located in Custer County, Colorado, and used for such minimum
<br />
<br />flows as are required to preserve the natural environment to
<br />
<br />a reasonable degree; and the claim: for appropriation is made
<br />
<br />under the provisions of CRS 1973, ~7-92-102 (3), 37-92-103 (3) ,
<br />(4) and (lO).
<br />
<br />4. That Applicant has furnished acceptable proof as to
<br />
<br />claims made.
<br />
<br />IT IS, THEREFORE, ORDERED AS FOLLOWS: That Applicant be,

<br />and is hereby, awarded an absolute water storage right, to-wit:
