RULING OF REFEREE

IN UPPER LILLY LAKE, A NATURAL
LAKE, IN THE WATERSHED OF THE
ARKANSAS RIVER,

IN HUERFANO COUNTY.

Pursuant to Order of Referral filed and entered in

the above case on December 29, 1977, the undersigned Water

Referee, having investigated the matter of the Application on

file herein, hereby makes the following findings and ruling

thereon:

FINDINGS OF FACT

1. That the said Application was filed on December 29,

1977.

2. That the Water Clerk caused publication of such filing

as provided by statute; that the time for filing Statements of

Opposition expired on the last day of February, 1978, and that

such a statement was filed on February 27, 1978, by Howard

Ilolme, Attorney at Law, on behalf of the Southeastern Colorado

Water Conservancy District.

3. That on March 16, 1978, the undersigned 11ater Referee

re-rcferred the case to the Water Judge pursuant to the authority

granted the said Referee in C.R.S. 1973, 37-92-303(2).

4. That on December 20, 1979, the said District withdrew

its objection, and on December 28, 1979, the Water Judge re-

manded the case to the undersigned Wat-er Referee for investiga-
tion and ruling thereon.
