containing, a variety of natural ecosystems- for' comparative
biol-ogi<:al studies;' and

(b) The Property contains representative sample~ of spruce-fir and
,alpine p~ant c:o~unities; and

'(c) The Property contains ~dditional scientific attributes as
described in Exhibit B, att-ached he'reeo and irtc:()rpo~ated

Cd) The Property i~ being manage~ by RHaL ?ur~uant to its lease
with, TNC as a research 'pre'serv'e -to: co'nti'fiue efforts to minimize'
the effects of research and-educational'activities~ to maintain

to foster basic research of the highest quality,

As a result of these attributes, the Property provides, ampng other

benefits, the following benefits:

, (a) It' fierves as an example o,f the native condition in studies
relating to air" water, and soil- Qua,11ty anel: habitat productivity;
and

(b) It s'er'Ves as resource material ,from which ,new knowledge may
be derived 'and as a reservoir of g,enetic'_material which has
present and future value to ,scie,ntific inqu.1ry;', and

(c) It serves as an outdoor- c18:ssr'Oom and laboratory far sc'ie'tltif-ic
study.

3. Ri~hts and Duties 2! the Department, The Department shall list the

Property as a des~gnated natural area of the Colorado Natural Areas SystemJ The

Department _shall provide, the Own~r with a Cer,tificate indicating said desig:q8tion,

Further, this designation evidences the desire of the Department that ~he Property

be protected from impacts adversely affecting the a~tributes for which the Property

was designated. To the extent that it has ,the authority to do'so; the Department

sh.all not publish any infor.mation- conce~n1ng the, location of the "Property other

than the name of the C~unty in which it 1s ~ocated.

(a)

Access. The Department has no authority to grant access to
the property without the.mutual co~sent of the OWner or
Lessee. Consent may be gIven when access would be consistent
with and promote the purposes of this Ag~eementa

(b)

Inspection. The Department shall-have the right to inspe~t the
Property from time to time tq confirm that it is being used solely
for the purposes stated in paragraph' 4a The Department shall '
give the Owner or Lessee ten (10) days prior notice of the date
and 'time it intends to inspect 'the, Property.
