<br />WHEREAS, - the Otmer owns cet'-tain paten,ted mi.-ning claims (which include the
<br />
<br />
<br />. accompanying surface rights) s,1tu<1ce in the County of G~nnis()n-" S,tate of C6lorado,.
<br />
<br />
<br />hereinafter the, Property;' and
<br />
<br />waEREAS, the Owner desiies that the natural chnracter of the Property be pre-
<br />
<br />served and pro tee tad;. and
<br />
<br />WHEREAS, the Department is authorized by the.Colorado Natural Areas Acc~ C.R.S.
<br />
<br />
<br />1973, 36-10-101, ~~, hereinafter the Act, to admini~ter a Colorado Nat~ral Are~s
<br />
<br />Program, hereinafter the Program;'and
<br />
<br />WHER~~, the Act establishes a Natural Area~ Council, hereinafter the Council,
<br />
<br />which advises ,the Department on the administration -pf the Program and which .:!p.provcs
<br />
<br />the designatio~ of Natural Area~ by the Department; ~nd
<br />
<br />WHEREAS, the DepareMent 'has determined, pur,uant to its criteria, that r:h~
<br />
<br />Property is a natural area which would be desirable to include with~n the Colorado
<br />
<br />Natural Areas System as a desigJ.'lated Natural Area'; ~nd
<br />
<br />WHEREAS, as a result of the attributes of t~e Property, the Property provides
<br />
<br />
<br />one or more of the benefits described in C.R.S. 197j, 36-10-104(1); and
<br />
<br />wH~REAS, the Owner has leased the Property to The Rocky Mountain ~iolog~cal
<br />
<br />Laboratory, hereinafter the Lessee or RMBL, by lease datad july 1. 1967, a copy of
<br />
<br />,which has been furnished to the Department.
<br />
<br />NOW THEREFORE it is hereby agreed that:
<br />
<br />1. Designation of Property' ~~ Natural Area. Upon filing of these 'Articles
<br />
<br />of Designation with, and ,the acceptance of same by, the Department,. wi'th the advice
<br />
<br />and approval of the Council, the Property describe,d in Exhibi't A, attached hereto
<br />
<br />and incorpora't;ed herein by reference, shall become a designated scienti.fic natural
<br />
<br />area and thereby shall become part, of the Colorado Natural Areas System. Said
<br />
<br />
<br />designated natural area shall be known as the Mexican Cut/Galena Mountain Scientific
<br />
<br />t{ntural Area.
