Failure or refusal by the board to make <br /> <br />apolication in water court for minimum lake level decrees <br /> <br />for the ponds totally located within the boundaries of the <br /> <br />state natural areas within six months of the signing of <br /> <br />this lease or the ponds outside and partially outside the <br /> <br />boundaries <br />subsequent <br /> <br />of the state natural areas as soon as practical, <br /> <br />to written access approval by the landowner; ~ <br />b. Failure or refusal by the board to defend 1l.DS <br /> <br />the validity and priori tv of the water rights owned by RMBL <br /> <br />WhiCh are the subject of the lease herein in whatever way <br /> <br />is necessary; <br /> <br />c. Loss of interest by the board in protecting <br /> <br />the purposes for which the decrees were filed or its refusal <br /> <br />or failure to protect this water from deterioration in Qual- <br /> <br />ity or Quantity; or <br /> <br />d. Prevention of access by RMBL personnel to <br /> <br />the subject sources by the board. <br /> <br />6. A~~igomeot.
