The Department has. de,terminedi upon recommend~tion <br /> <br />by the Council, that the Property qualifies as a natural area_. to be included in t;he <br /> <br />Colorado Natural Areas System due co' ,the fOllowing: <br /> <br />(8) The'Property contains a unique- serie~ of glaGiat shelf ponds <br />containing. a variety of natural ecosystems fot:' comparative <br />biological studies;" and <br /> <br />(b) The Property contains representative sample~ of spruce-fir and <br />.alpine p~ant c:o~unities; and <br /> <br />. (c) The Property contains ~dditional scientific attributes as <br />described in Exhibit B, att.ached he.rete and irtc:()rpo~ated <br />herein by reference; and <br /> <br />Cd) The Property i~ being manage~ by RHaL ?ur~uant to its lease <br />with. TNC as a research 'pre'serv'e -to: co'nti'Que efforts to minimize' <br />the effects of researeh and-educational'activities~ to maintain <br />, the ar':'l3 as 1so,la.ted as possiblfa',fro:rfi external- influences, and-:'- <br />tq faster basic research of the highest quality. <br /> <br />As a tesule of these attributes, the Property provides, ampng other <br /> <br />benefits, the following benefits: <br /> <br />. (a) It' fierves as an example o,f the native condition in studies <br />relating to air" water, and soil- Qua.11ty ane}: habitat productivity; <br />and <br /> <br />(b) It s'er'Ves as resource material .from which ,new knowledge may <br />be derived 'and as a reservoir of g,enetic'_material which has <br />present and future value to ,scie,ntific inqu.1ry;', and <br /> <br />~- <br /> <br />(c) It serves as an outdoor- c18:ssr'Oom and laboratory for sc'ie'tltif-ic <br />study. <br /> <br />3. Ri~hts and Duties 2! the Department. The Department shall list. the <br /> <br /> <br />Property as a des~gnated natural area of the Colorado Natural Areas SystemJ The <br /> <br />Department _shall provide, the Own~r with a Cer,tificate indicating said desig:q8tion. <br /> <br />Further, this designation evidences the desire of the Department that ~he Property <br /> <br />he protected from impacts adversely affe~ting the a~tributes for which the Property <br /> <br /> <br />was designated. To the extent that it has.the authority to do'so; the Department <br /> <br />sh.all not publish any infor.mation- conce~ning the, location of the "Property other <br /> <br />than the name of the C~unty in which it 1s ~ocated. <br /> <br />(a) <br /> <br />Access. The Department has no authority to grant access to <br />the property without the.mutual co~sent of the OWner or <br />Lessee. Consent may be gIven when access would be consistent <br />with and promote the purposes of this Ag~eementa <br /> <br />(b) <br /> <br />Inspection. The Department shall-have the right to inspe~t the <br />Property from time to time tQ confirm that it is being used solely <br />for the purposes stated in paragraph' 4a The Department shall . <br />give the Owner or Lessee ten (10) days prior notice of the date <br />and 'time it intends to inspect 'the, Property. <br /> <br />Page 2 of 4 <br />
