WHEREAS, - the Otmer owns cet'-tain paten.ted mining claims (which include the

. accompanying surface rights) s,1tu<1ce in the County of G~nnis()n" S.tate of C61orado,.

hereinafter the. Property;' and

waEREAS, the Owner desiies that the natural character of the Property be pre-

served and procec ted;. and

WHEREAS, the Department is authorized by the.Colorado Natural Areas Acc~ C.R.S.

1973, 36-10-101, ~~, hereinafter the Act, to admini~ter a Colorado Nat~ral Are~s

Program, hereinafter the Program;"snd

WHER~~, the Act establishes a Natural Area~ Council, hereinafter the Council,

which advises ,the Department on the administration -pf the Program and which .:!p.provcs

the designatio~ of Natural Area~ by the Department; ~nd

WHEREAS, the Department 'has determined, pur,uant to its criteria, that r:h~

Property is a natural area which would be desirable to include with~n the Colorado

Natural Areas System as a desigJ.'lated Natural Area'; ~nd

WHEREAS, as a result of the attributes of t~e Property, the Property provides

one or more of the benefits described in C.R.S. 197j, 36-10-104(1); and

wH~REASt the Owner has leased the Property to The Rocky Mountain ~iolog~cal

Laboratory, hereinafter the Lessee or RMBL, by lease datad july 1. 1967, a copy of

.which has been furnished to the Department.

NOW THEREFORE it is hereby agreed that:

1. Desl~nation of Property' ~~ Natural Area. Upon filing of these 'Articles

of Designation with, and ,the acceptance of same by, the Department, wi'th the advice

and approval of the Council, the Property describe,d in Exhibi't A, attached hereto

and incorpors.t;ed herein by reference, shall become a designated scienti.fic natural

area and thereby shall become part. of the Colorado Natural Areas System. Said

designated natural area shall be known as the Mexican Cut/Galena Mountain Scientific

t{ntural Area.
