<br />.. <br /> <br />.) <br /> <br />.1 <br />, <br /> <br />.J <br /> <br />1 <br />2 <br /> <br />(5) An affected local government as JGfmcd in Se-aion 25-15-J 24, <br />may file suit in district court to enjoin actual or threatened violations of <br /> <br />3 any environmental covenant that applies to land within its jurisdiction, <br />4 (6) No environmental covenant shall be unenforceable because of <br />5 lack of privity of contract or lack of benefit to a particular parcel of land, <br />6 BECAUSE OF A FAILURE OF NOTICE OR RECORDATION UNDER SECTION <br />7 25-15-321, because the environmental covenant does not expressly state <br />8 that it runs with the land, or because of any other inconsistency with <br />9 common law requirements applicable to common law covenants. <br />10 SECTION 8. 25-15-323, Colorado Revised Statutes, is amended <br />11 to read: <br />12 25-15-323. Registry of environmental covenants. (I) The <br />13 department shall create and maintain a registIy of all environmental <br /> <br />14 <br />15 <br /> <br />covenants, including any modification or termination thereof. THE <br /> <br />REGISTRY MAY ALSO CONTAIN ANY OTHER INFORMATION CONCERNING <br /> <br />16 ENVIRONMENTAL COVENANTS AND THE REAL PROPERTY SUBJECT TO THEM <br />17 THAT THE DEP ARTMENT CONSIDERS APPROPRIATE. THE REGISTRY SHALL <br />18 BE A PUBLIC RECORD, <br />19 (2) AFTER AN ENVIRONMENTAL COVENANT OR AN AMENDMENT OR <br />20 TERMINATION OF A COVENANT IS FILED IN THE REGISTRY MAINTAINED <br />21 PURSUANT TO SUBSECTION (1) OF THIS SECTION, A NOTICE OF THE <br />22 COVENANT, AMENDMENT, OR TERMINATION THAT COMPLIES WITB THIS <br />23 SECTION SHALL ALSO BE RECORDED IN THE LAND RECORDS. THIS NOTICE <br />24 SHALL CONTAIN: <br />25 (a) A LEGALLY SUFFICIENT DESCRIPTION AND ANY AVAILABLE <br />.26 STREET ADDRESS OF THE REAL PROPERTY SUBJECT TO THE COVENANT; <br /> <br />27 <br /> <br />(b) THE NAME AND ADDRESS OF THE OWNER OF THE FEE SIMPLE <br /> <br />-21- ' <br /> <br />SB05-246 <br />
