<br />., <br /> <br />I <br />2 <br /> <br />OF INDEXING, THE DEPARTMENT AND A HOLDER SHALL BE TREATED AS A <br />GRANTEE. EXCEPT AS OTHERWISE PROVIDED IN SECTION 25-15-318 (2), AN <br /> <br />. <br /> <br />3 ENVIRONMENTAL COVENANT IS SUBJECT TO THE LAWS OF THIS STATE <br />4 GOVERNING RECORDING AND PRIORITY OF INTERESTS IN REAL PROPERTY. <br /> <br />5 SECTION 7.25-15-322 (2),(4), (5), and (6), Colorado Revised <br />6 Statutes, are amended to read: <br />7 25-15-322. Enforcement - remedies. (2) In the event of an <br />8 actual or threatened failure to comply with an'environmental covenant, <br />9 the departrneIlt may issue an order under this section requiring <br />10 compliance With the terms of the environmental covenant and may <br />11 request the attorney general to bring suit in district court to enforce the <br />12 terms of the environmental covenant, to enforce the AN order issued <br />13 pursuant to this section, or to seek other appropriate injunctive relief. An <br /> <br />14 <br /> <br />administrative order issued under this subsection (2) shall be subject to <br /> <br />. <br /> <br />15 appeal in accordance with section 25-15-308, <br />16 (4) The: !Simlor of ANY PARTY TO an environmental covenant, <br /> <br />- <br />17 INCLUDING THE GRANTOR, THE DEPARTMENT, THE HOLDER, ANY OTHER <br />18 PERSON TO WHOM THE COVENANT EXPRESSLY GRANTS ENFORCEMENT <br /> <br />19 POWERS, AND ANY PERSON WHOSE INTEREST IN THE PROPERTY OR WHOSE <br />20 COLLATERAL OR LIABILITY MAY BE AFFECTED BY A VIOLATION OF THE <br />21 COVENANT may file suit in district court to enjoin actual or threatened <br />22 violations of the covenant, Any th.i1d pfuty bc:ndiGiatJ ~pccifie-ally <br /> <br />23name-d in an e:nvtlOm.lwtal "Ove-Mot may file suit.in dj5tr~'l <-Owt to <br />24 enjoin actual 01 tl:ue-atc;ncd violations oftltc; C-OvCnllnt.
