<br />~ <br />~ <br />~ <br /> <br />. Requires the department to establish and maintain a land <br />use dispute panel in each of the state's judicial districts to <br />serve as hearing officers. Specifies that such officers shall <br />be entitled to compensation at a per diem rate. Specifies the <br />qualifications required of members of the land use dispute <br />panel. <br />. Specifies procedures to be followed in connection with a <br />civil action brought under the Act. Requires the district <br />court to appoint a hearing board consisting of 3 members of <br />the land use dispute panel to hear the matter. Specifies <br />procedures to be followed in connection with the selection <br />of the hearing board panelists. <br />. Requires the hearing board members to hear and determine <br />the dispute. Authorizes the hearing board to proceed by <br />certiorari review or evidentiary hearing and specifies which <br />type of proceeding merits the different types of review. <br />Allows an appeal from a decision of the hearing board to be <br />made directly to the Colorado court of appeals. <br />. Authorizes any 2 or more local governments to utiilize the <br />service of the land use dispute panel as mediators in <br />connection with any dispute or disagreement between such <br />local governments arising under or related to the provisions <br />of the Act or any action taken by a local government <br />pursuant to the provisions of the Act. <br />Provides that intergovernmental agreements concerning land use <br />planning or to which a local government is a party may be made mutually <br />binding and enforceable on a long-term basis. <br />Provides that, if a municipality approves an annexation in which <br />the contiguity requirement of existing law is achieved by annexing a <br />platted street or alley, a public or private right-of-way, a public or private <br />transportation right-of-way, or a specified form of natural or artificial <br />waterway, the municipality is further required to annex certain la.nd that <br />abuts such street, alley, right-of-way, or waterway where the same is <br />included within the municipality's designated urban service area. <br />Defines terms. <br /> <br />Be it enacted by the General Assembly of the State of Colorado: <br />2 SECTION 1. Title 24, Colorado Revised Statutes. is amended BY <br />3 THE ADDITION OF A NEW ARTICLE to read: <br />4 Article 63 <br /> <br />5 Colorado Growth Manal!ement Act <br /> <br />-6- <br /> <br />1225 <br />
