IN DESIGNING SUCH REGULATIONS. THE <br /> <br />JURISDICTION SHALL IDENTIFY MEASURES TO GIVE PRIORITY TO LAND <br /> <br />WITHIN DESIGNATED SENDING AREAS WITH THE FOLLOWING ATTRIBUTES: <br /> <br />(I) HIGHLY PRODUCTIVE AGRICULTURAL LAND; <br />(II) CONSERVATION AND OPEN SPACE LAND: OR <br />(III) LAND THAT IS IMPORTANT FOR PRESERVING VIEWSHEDS. <br /> <br />RIDGELlNES, CORRIDORS, COMMUNITY BUFFER ZONES, AND OTHER <br /> <br />ELEMENTS OF THE LANDSCAPE THAT ARE IMPORT ANT TO THE JURISDICTION. <br /> <br />(b) THE REGULATIONS IMPLEMENTING PARAGRAPH (a) OF THIS <br /> <br /> <br />SUBSECTION (9) SHALL BE DESIGNED TO GIVE A PRIORITY IN THE PURCHASE <br /> <br />OF TRANSFERABLE DEVELOPMENT RIGHTS TO DEVELOPMENT RIGHTS ON <br /> <br />LAND THAT IS REASONABLY NEAR THE DEVELOPMENT FOR WHICH <br /> <br />ADDITIONAL DEVELOPMENT RIGHTS ARE BEING PURCHASEDANDTOENSURE <br /> <br />THAT AN INDIVIDUAL PARCEL OF LAND FROM WHICH A TRANSFERABLE <br /> <br />DEVELOPMENT RIGHT IS BEING PURCHASED IS OF A SUFFICIENT SIZE. <br /> <br />LOCATION, AND CHARACTER TO PROVIDE MEANINGFUL CONSERVATION, <br /> <br />AGRICULTURAL, OR OPEN SPACE BENEFITS. <br /> <br /> <br />(c) FOR THE PURPOSES OF SATISFYING THE REOUIREMENTS OF <br /> <br /> <br />PARAGRAPH (a) OF THIS SUBSECTION (9) AND PARAGRAPH (d) OF <br /> <br /> <br />SUBSECTION (2) OF THIS SECTION. THE JURISDICTION MAY UTILIZE A <br /> <br />TRANSFERRABLE DEVELOPMENT RIGHTS PROGRAM IN EXISTENCE AS OF <br /> <br />JULY I. 200 1. ANY SUCH EXISTING TRANSFERRABLE DEVELOPMENT RIGHTS <br /> <br />PROGRAM SHALL BE CONSIDERED TO BE CONSISTENT WITH THIS SECTION <br /> <br />FOR ALL PURPOSES. <br /> <br />(d) (I) THE GENERAL ASSEMBLY SHALL ESTABLISH A COMMITTEE TO <br /> <br />MEET IN THE INTERIM AFTER THE FIRST REGULAR SESSION OF THE <br /> <br />SIXTY-THIRD GENERAL ASSEMBLY TO STUDY, REVIEW. AND EVALUATE <br /> <br />-47- <br /> <br />1225 <br />
