All interest earned on the inves1ment of moneys in the fund <br />3 shall be credited to the fund. Moneys in the fund shall be appropriated <br />4 solely to the division of water 1eS0tl1~C5 ADMINISTRATION for costs <br />5 associated with the investigation and enforcement of violations of orders <br />6 issued by the state engineer or the commission for the illegal withdrawal <br />7 of designated ground water, including costs associated with the <br />8 implementation of this section. <br />9 SECTION 34. 37-90-116 (1) (t), Colorado Revised Statutes, is <br />10 amended to read: <br />11 37-90-116. Fees - ground water publication fund - repeal. <br />12 (1) The state engineer or the commission shall collect the following fees: <br />13 (f) The actual expenses of publication, if any is required, which <br />14 sums shall be promptly billed to the applicant and paid prior to the <br />15 approval of any permit or other application, unless the commission <br />16 requires the applicant to pay these expenses directly to the newspaper, <br />17 and the applicarrt provides a proof of such payment to the commission; <br />18 except that, when a publication is made to process final permits pursuant <br />19 to section 37-90-108, such publication expenses shall be paid by the state <br />20 engineer from the di vision of ..ate1 Ics.oUlecs ground water management <br />21 cash fund created ptl1suant to IN section 37-80-111.5 (I) (d). All such <br />27 _I1lJhlig<!t!QI! ~J:p~nses..cQlkct~1:Lby: the state engineeroLby_the commission <br />23 shall be transmitted to the state'treasurer, who shall credit the same to the <br />24 ground water publication fund, which fund is hereby created.
