<br />~ <br /> <br />(1) .Continuing C011tr~" lIleanS II CO'Itnc:t for p1"ofessional <br />~erv;ces entere.cl into pursuant to thi~ ~rt 14 beUfeen a state <br />agency and a per-; on , whereby the per-;on provides professional <br />s~rv;ces to the state agency f!)r wrk of a specified Mture as- <br />out 1i ned ; n 'the <:ontract requ; red by the state agency wi th no . <br />specific: time limitation. fury $uch contract shall provide a <br />tp.rmination clause. <br /> <br />(2) "Dej>artJnent" means the department of .ouinistr.dti'Ofl. <br /> <br />(3) "flers.on" llleans an imlividual. ~ corporation, a <br />pcrtnership, a business trust, an association, II f1OM, ~r any <br />0ther legal entity. <br /> <br />(4) "Practic~ of landscape architecture" tleans the <br />performance of professional s~rvices such liS consultation, <br />investigation, reconnaissance, research, planning, ~ign, or <br />responsible supervision in connection ~ith the development of <br />iand areas or land use, where and to.tne extent that the dominant <br />purpose of any such service is the preservation and development <br />of existing and proposed land features, ground surface, planting, <br />r.atura1istic features,. and esthetic values. .Practice of <br />landscape architecture. includes the design, location, and <br />arrangement of such tangible objects and features as are <br />~ncidental and necessary to the purposes outlined in this' <br />subsection (4), but the term does not include the ma~ing of land <br />surveys or final engineered plats for official ~cording, <br />;ntegration of design of structures of earth, or other <br />:~nstruction materials. <br /> <br />(5) "Principal representative" means the QOverning board of <br />c state department, institution, or agency or. if there is no <br />Qoverning board, the executive head of a state department, <br />;nstitution, or agency, as designated by the governor or the <br />92neral assembly. <br /> <br />(6) uProfessiona1 services.
