<br />1 used in this section AND SECTION 37-60-126.5, unless the context <br /> <br /> <br />2 otherwise requires: <br /> <br />3 (a) "Covered entity" OR "WATER PROVIDER" means each A <br /> <br /> <br />4 municipality, agency, utility, including any privately owned utility, or <br /> <br /> <br />5 other publicly owned entity with THAT HAS a legal obligation to supply, <br /> <br /> <br />6 distribute, or otherwise provide water at retail to domestic, commercial, <br /> <br /> <br />7 industrial, or public facility customers and wIrieh THAT has a total <br /> <br /> <br />8 demand for such customers oftwo thousand acre-feet or more in calendar <br /> <br /> <br />9 years 1989 or thereafter. <br /> <br /> <br />10 (b) "Public facility" means any facility operated by an instrument <br /> <br />11 of government for the benefit of the public, including, but not limited to, <br /> <br /> <br />12 a government building, park or other recreational facility, school, college, <br /> <br /> <br />13 university, or other educational institution, highway, hospital, or stadium. <br /> <br />14 (c) "SINGLE-FAMILY RESIDENTIAL PER CAPITA WATER USE" MEANS <br /> <br />15 THE TOTAL VOLUME OF TREATED WATER SOLD TO SINGLE-FAMILY <br /> <br /> <br />16 RESIDENTIAL ACCOUNTS DIVIDED BY THE NUMBER OF SINGLE-FAMILY <br /> <br /> <br />17 ACCOUNTS DIVIDED BY THE AVERAGE SINGLE-FAMILY HOUSEHOLD <br /> <br /> <br />18 OCCUPANCY IN THE SERVICE AREA. <br /> <br /> <br />19 (d) "SYSTEMWIDE PER CAPITA WATER USE" MEANS THE TOTAL <br /> <br /> <br />20 VOLUME OF TREATED W ATERDlVIDED BY THE SERVICE AREA POPULATION. <br /> <br /> <br />21 (e) "UNACCOUNTED-FOR WATER" MEANS THE DIFFERENCE <br /> <br /> <br />22 BETWEEN THE TOTAL VOLUME OF TREATED WATER AND THE TOTAL <br /> <br />23 VOLUME OF TREATED WATER SOLD. <br /> <br /> <br />24 (t) "WATER USE EFFICIENCy"MEANS STRETCHING EXISTING WATER <br /> <br /> <br />25 SUPPLIES TO MEET A LARGER PORTION OF FUTURE URBAN WATER NEEDS, <br /> <br /> <br />26 TAKING INTO ACCOUNT ECONOMIC, SOCIAL, AND ENVIRONMENTAL COSTS. <br /> <br />27 SECTION 3.
