<br />~~~;>>~:<\:l <br /> <br />I'~,;,~-:'_.' <br />t~'Jl;;:]i2", <br />~~~ <br />,...~ <br /> <br />" <br />~~;;._...;,,:~ <br /> <br />~.... <br />[i~1::'-' <br />F\ -L;~".. <br />~t~'"' " <br />!'.--."tr"".-,---- <br />t"IL:rJ"" <br /> <br />'",.,",,-- <br /> <br />1 ACCORDANCE WITH THE PROVISIONS OF SUBSECTION (I) OF THIS SECTION, <br /> <br /> <br />2 THE PROCESS FOR OBTAINING APPROVAL OF SUCH DEVELOPMENT <br /> <br />3 APPLICATION SHALL BE GOVERNED BY THE MUNICIPAL PLANNING <br /> <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />II <br />12 <br />13 <br /> <br />JURISDICTION'S ADOPTED MASTER PLAN, LAND DEVELOPMENT <br /> <br />REGULATIONS, STANDARDS, AND PROCEDURES, AND ANY APPROVAL <br /> <br />GRANTED BY THE MUNICIPAL PLANNING JURISDICTION SHALL BE BINDfNG <br /> <br />ON THE COUNTY. <br /> <br />(3) No MUNICIPAL PLANNING JURISDICTION SHALL PROCEED WITH <br />ANNEXATION OF LAND PURSUANT TO SUBSECTION (I) OF THIS SECTION <br /> <br />UNLESS IT SHALL BE CAPABLE OF PROVIDfNG URBAN SERVICES TO THE <br /> <br />ANNEXED AREA WITHIN ONE YEAR OF THE EFFECTIVE DATE OF THE <br /> <br />ANNEXATION OR, WHERE THE MUNICIPAL PLANNING JURISDICTION HAS <br /> <br />ENTERED INTO AN ANNEXATION AGREEMENT OR DEVELOPMENT <br /> <br />14 AGREEMENT WITH THE OWNER OF THE ANNEXED AREA PURSUANT TO <br /> <br />IS SECTION 24-68-1 04, SHALL BECAPABLEOF PROVIDING URBAN SER VICES TO <br /> <br />16 AT LEAST THE FIRST PHASE OFTHE PROPOSED DEVELOPMENT WITHfN THREE <br /> <br />17 YEARS AFTER THE EFFECTIVE DATE OF THE ANNEXATION. <br /> <br />18 (4) NOTHING IN THIS SECTION SHALL BE CONSTRUED AS GRANTfNG <br />19 ANY AUTHORITY TO A PLANNING JURISDICTION THATIS A MUNICIPALITY TO <br /> <br />20 IMPOSEEITHERAMORATORIUM ON DEVELOPMENT APPROVALORAGROWTH <br /> <br />21 LIMITATION OUTSIDE OF ITS INCORPORATED BOUNDARIES. <br /> <br />22 (5) NOTHING IN THIS SECTION SHALL BE CONSTRUED AS GRANTING <br />23 ANY COUNTY ANY AUTHORITY TO REQUIRE LANDOWNERS TO SEEK <br />24 ANNEXATION OF ANY LAND PRIOR TO THE DEVELOPMENT OF SUCH LAND <br /> <br />25 WHERE THE LAND IS WHOLLY LOCATED OUTSIDE THE URBAN SERVICE AREA <br /> <br />26 OF ANY PLANNING JURISDICTION THAT IS A MUNICIPALITY. <br /> <br />27 24-63-403.
