A <br /> <br />COUNTY SHALL MAKE THE INITIAL DETERMINATION OF ELIGIBILITY FOR <br /> <br />ANNEXATION AND REFER THE LANDOWNER TO THE PLANNING JURISDICTION <br /> <br />AS AUTHORIZED BY THIS SECTION WITHIN THIRTY DAYS AFTER ITS RECEIPT <br /> <br />OF THE PRELIMINARY DEVELOPMENT APPLICATION. WHEREACOUNTYHAS <br /> <br />REQUIRED THE LANDOWNER TO SEEK ANNEXATION BY A MUNICIPAL <br /> <br />PLANNING JURISDICTION PURSUANT TO THE TERMS OF THIS SECTION AND <br /> <br />THE MUNICIPAL PLANNING JURISDICTION EITHER NOTIFIES THE LANDOWNER <br /> <br />THAT IT IS UNWILLING OR UNABLE TO ENTERTAIN A PETITION FOR <br /> <br />15 PLANNING JURISDICTION'S RECEIPT OF SUCH APPLICATION ACCORDING TO <br /> <br />ANNEXATION WITHIN SIXTY DAYS AFTER THE DATE OF THE MUNICIPAL <br /> <br />16 THE PROCEDURES SET FORTH IN ARTICLE 12 OF TITLE 31, C.R.S., OR <br /> <br />17 IMPOSES CONDITIONS FOR APPROVAL OF THE ANNEXATION THAT ARE <br /> <br />18 UNACCEPTABLE TO THE LANDOWNER, THE COUNTY SHALL CONSIDER THE <br />19 LANDOWNER'S DEVELOPMENT APPLICATION FOR SUBDIVISION OR <br /> <br />20 DEVELOPMENT IN ACCORDANCE WITH ITS MASTER PLAN, LAND <br />21 DEVELOPMENT REGULATIONS, STANDARDS, AND PROCEDURES, INCLUDING <br />22 APPLICABLE ZONING AND SUBDIVISION REGULATIONS, <br /> <br />23 <br /> <br />(2) WHERE A COUNTY REQUESTS A LANDOWNER WHO HAS <br /> <br />24 SUBMITTED AN APPLICATION FOR SUBDIVISION, OR FOR APPROVAL OF <br />25 DEVELOPMENT THAT INCLUDES URBAN GROWTH, TO SEEK ANNEXATION BY <br />26 A MUNICIPAL PLANNING JURISDICTION AND THE MUNICIPAL PLANNING <br /> <br />27 JURISDICTION GIVES NOTICE OF ITS INTENT TO ANNEX SUCH LAND IN <br /> <br />-47- <br /> <br />148 <br />
