FROM CONSTRUCTING A SINGLE- <br /> <br />F AMIL Y RESIDENTIAL DWELLING UTILIZING AN INDIViDUAL SEPTIC SYSTEM. <br /> <br />THIS PARAGRAPH (a) SHALL NOT BE CONSTRUED TO PERMIT THE OWNER OF <br /> <br />MULTIPLE CONTIGUOUS PARCELS OF LAND TOTALING LESS THAN THIRTY <br /> <br />FIVE ACRES FROM CONSTRUCTING MORE THAN ONE RESIDENTIAL DWELLING <br /> <br />UNIT. THIS PARAGRAPH (a) SHALL NOT BE CONSTRUED AS EXPANDING OR <br /> <br />CREATING ANY VESTED RIGHTS, AND ALL OTHER APPLICABLE LAND USE <br /> <br />REGULATIONS SHALL APPLY. <br /> <br />(II) A LOCAL PLANNING JURISDICTION MAY ALLOW OR APPROVE, IN <br />ACCORDANCE WITH ITS LAND USE REGULATIONS: <br /> <br />(A) DEVELOPMENT NECESSARY TO ALLOW FOR NATURALLY <br /> <br />PRODUCTIVE USES. INCLUDING COMMERCIALF ACILITlES DIRECTL YRELATED <br /> <br />TO SUCH USES: <br />(B) PUBLICLY OWNED FACILITIES NECESSARY FOR THE PUBLIC <br /> <br />HEALTH, SAFETY. AND WELFARE. INCLUDING. WITHOUT LIMITATION. <br /> <br />SCHOOLS AND OTHER EDUCATIONAL FACILITIES: AND <br />(C) THE USE OF RURAL LANDS AS SPECIFIED IN SUBSECTION (3) OF <br /> <br />THIS SECTION. <br /> <br />(b) NOTWITHSTANDING ANY OTHER PROVISION OF THIS SECTION <br /> <br />AND EXCEPT FOR AN APPLICATION REGARDING ELECTRIC OR NATURAL GAS <br /> <br />FACILITIES.
