Disputes arising under the Act and in the land use process <br />in general should be resolved as quickly, efficiently, and <br />informally as possible and with minimum cost to the <br />disputing parties. <br />. The general assembly does not intend to deprive any <br />landowner of any existing vested rights created by statute, <br />contract, or common law, or of any property rights derived <br />from the state or federal constitutions or to abrogate any <br />contractual obligations ofthe state or any local govemments <br />in implementing the Act <br />Specifies that every municipality and county in the state and all <br />units of state and local govemment are subject to the provisions of the <br />Act <br />Specifies that the terms of the Act preempt inconsistent laws, <br />ordinances, or regulations adopted by any local planning jurisdiction. <br />Specifies that ifthere is any conflict between any provision of the Act and <br />any other provision of state law, the provisions of the Act shall control. <br />In connection with requirements of the Act pertaining to regional <br />planning: <br />. <br /> <br />. <br /> <br />Requires regional plans to be created in specified areas of <br />the state. Provides that regional plans may be created in <br />other specified areas of the state. <br />Requires that any set of counties and municipalities that is <br />required to or chooses to create a regional planning <br />commission shall create a regional planning commission. <br />Specifies that for the Denver region, the regional planning <br />commission shall be the Denver regional council of <br />governments as constituted on January l, 2001. Specifies <br />that a representative of the office of the govemor, or the <br />governor's designee, shall be a member ofthe commission. <br />Requires each regional planning commission to create and <br />adopt a regional plan by a specified period. <br />Provides that a regional plan shall become binding when <br />adopted by representatives of a majority of the regional <br />planning commission where such members represent a <br />majority of the population in the region. <br />Requires each regional planning commission to adopt <br />regulations governing adoption of its regional plan and any <br />amendments to the regional plan. <br />Specifies procedures to be followed in connection with the <br />adoption or amendment of the regional plan, including <br />requirements relating to public notice. <br />Specifies that the regional plan shall include a broad set of <br />regional goals and a list of elements and strategies setting <br />forth how the region shall achieve the desired goals, <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />-2- <br /> <br />148 <br />
