1 TO THE GROUND WATER COMMISSION AND TO THE BOARD OF DIRECTORS

2 OF ANY GROUND WATER MANAGEMENT DISTRICT WITHIN WHICH SUCH

3 LANDS ARE LOCATED,

4 (f) (n SUBJECT TO SUBPARAGRAPH (II) OF THIS PARAGRAPH (fl. no

5 city. or citv and county. having a population of more than twenty-five

6 thousand as determined by the last United States census shall be included

7 within such area proposed to be included within the district unless by and

8 with the written consent of the chief executive officer of such city, or city

9 and county, with the approval of the legislative body of such

10 municipality, and such consent may specify that the rate of taxation on

11 the valuation for assessment of property within said THE city, or city and

12 county, under section 37-45-122, shall not exceed a maximum rate whieh

13 THAT may be less than the rates set out in said section 37-45-122, and in

14 such case the district shall not have power to levy an assessment on the

15 property in said THE city, or city and county, at a greater rate than that

16 specified in said THE consent.

17 (II) No LANDS THAT FALL WITHIN THE BOUNDARY OF A

18 DESIGNATED GROUND WATER BASIN SHALL BE INCLUDED WITHIN SUCH

19 AREA PROPOSED TO BE INCLUDED IN THE DISTRICT EXCEPT UPON THE

20 WRITTEN CONSENT OF THE GROUND WATER COMMISSION AND THE BOARD

21 OF DIRECTORS OF ANY GROUND WATER MANAGEMENT DISTRICT WITHIN

22 WHICH SUCH LANDS ARE LOCATED, THIS SUBP ARAGRAPH (II) IS REPEALED.

23 EFFECTIVE JANUARY 1. 2005.

24 (3.5) (a) ill As an alternative to the procedures set forth in

25 subsections (2) and (3) of this section, a petition for inclusion and for an

26 election on inclusion oflands within a water conservancy district may be

27 filed in the district court of the county in which the petition for
