<br />1 TO THE GROUND WATER COMMISSION AND TO THE BOARD OF DIRECTORS <br /> <br /> <br />2 OF ANY GROUND WATER MANAGEMENT DISTRICT WITHIN WHICH SUCH <br /> <br />3 LANDS ARE LOCATED, <br /> <br /> <br />4 (f) (n SUBJECT TO SUBPARAGRAPH (II) OF THIS PARAGRAPH (fl. no <br /> <br /> <br />5 city. or citv and county. having a population of more than twenty-five <br /> <br />6 thousand as determined by the last United States census shall be included <br /> <br /> <br />7 within such area proposed to be included within the district unless by and <br /> <br /> <br />8 with the written consent of the chief executive officer of such city, or city <br /> <br /> <br />9 and county, with the approval of the legislative body of such <br /> <br /> <br />10 municipality, and such consent may specify that the rate of taxation on <br /> <br /> <br />11 the valuation for assessment of property within said THE city, or city and <br /> <br />12 county, under section 37-45-122, shall not exceed a maximum rate whieh <br /> <br /> <br />13 THAT may be less than the rates set out in said section 37-45-122, and in <br /> <br /> <br />14 such case the district shall not have power to levy an assessment on the <br /> <br /> <br />15 property in said THE city, or city and county, at a greater rate than that <br /> <br />16 specified in said THE consent. <br /> <br /> <br />17 (II) No LANDS THAT FALL WITHIN THE BOUNDARY OF A <br /> <br /> <br />18 DESIGNATED GROUND WATER BASIN SHALL BE INCLUDED WITHIN SUCH <br /> <br /> <br />19 AREA PROPOSED TO BE INCLUDED IN THE DISTRICT EXCEPT UPON THE <br /> <br /> <br />20 WRITTEN CONSENT OF THE GROUND WATER COMMISSION AND THE BOARD <br /> <br /> <br />21 OF DIRECTORS OF ANY GROUND WATER MANAGEMENT DISTRICT WITHIN <br /> <br /> <br />22 WHICH SUCH LANDS ARE LOCATED, THIS SUBP ARAGRAPH (II) IS REPEALED. <br /> <br />23 EFFECTIVE JANUARY 1. 2005. <br /> <br /> <br />24 (3.5) (a) ill As an alternative to the procedures set forth in <br /> <br />25 subsections (2) and (3) of this section, a petition for inclusion and for an <br /> <br /> <br />26 election on inclusion oflands within a water conservancy district may be <br /> <br />27 filed in the district court of the county in which the petition for <br /> <br />-8- <br /> <br />118 <br />
