3 SECTION 4. 37-45-109 (2.5) (a) and (3) (d), Colorado Revised

4 Statutes, are amended to read:

5 37-45-109. Petition - repeal. (2.5) (a) ill As an alternative to

6 the procedures set forth in subsections (1) and (2) of this section, a

7 petition for an election on the organization of a water conservancy district

8 may be filed with the clerk of the court vested with jurisdiction in a

9 county in which all or part of the lands embraced in such proposed

10 district is situated, The petition shall be signed by not less than ten

11 percent or two hundred electors of the proposed special district,

12 whichever number is smaller. SUBJECT TO SUBPARAGRAPH (II) OF THIS

13 PARAGRAPH Cat the proposed boundarv of the special district may include

14 anv part or all of any city or city and county of anv size. Such petition

15 and the hearing thereon shall otherwise comply with the provisions of this

16 article which THAT are not inconsistent with the provisions of this

17 subsection (2,5),

18 (II) THE PROPOSED BOUNDARY OF THE..SPEClALDlSIRlClMAY NOT

19 INCLUDE ANY LANDS WITHIN A DESIGNATED GROUND WATER BASIN EXCEPT

20 UPON THE WRITTEN CONSENT OF THE GROUND WATER COMMISSION AND

21 THE BOARD OF DIRECTORS OF ANY GROUND WATER MANAGEMENT

22 DISTRICT WITHIN WHICH SUCH LANDS ARE LOCATED. THIS SUBPARAGRAPH

23 (II) IS REPEALED. EFFECTIVE JANUARY 1. 2005.

24 (3) The petition shall set forth:

25 (d) Whether 01 not any part of the proposed district is included

26 within the boundaries of a district already in existence under the

27 provisions of this article OR WITHIN THE BOUNDARIES OF A DESIGNATED
