1 JANUARY 1. 2005, 2 SECTION 8. 37-45-137 (2), Colorado Revised Statutes, IS 3 amended to read: 4 37-45-137. Exclusion of lands - repeal. (2) (a) SUBJECT TO 5 PARAGRAPH (b) OF THIS SUBSECTION (2). following organization of a 6 district under this article at any time prior to authorization for the 7 incurring of bonded or other indebtedness under the election procedures 8 set forth in sections 37-45-139 to 37-45-142 and prior to the execution of 9 a contract with the United States or any of its agencies, the governing 10 body ofany A city, city and county, or town, regardless of its population, 11 originally included in the district without consent given in the manner 12 provided in section 37-45-109, and over an express objection made in 13 writing to the court in which the petition for organization has been filed 14 at any time prior to the date upon which the court declares the district 15 organized, may pass an ordinance declaring all property, real and 16 personal, within the limits of said public corporation, to be lands and 17 property excluded from the district. Upon service bv registered or 18 certified _ mail of a certified COR)' of said TI:ULor:dinance_oR 19 RESOLUTION upon the division of local government in the department of 20 local affairs, the board of directors of the district, the court organizing 21 said THE district, the assessor or treasurer, and the county clerk and 22 recorder of the county in which that public corporation OR DESIGNATED 23 GROUND WATER BASIN is located, said THE city, city and county, or town, 24 DESIGNATED GROUND WATER BASIN, OR GROUND WATER MANAGEMENT 25 DISTRICT, and all lands and property within its SUCH ENTITY'S limits, shall 26 ft'Jrth~i(h be automatically excluded from the district, and said THE 27 property and lands within the limits of said public cOlpo1at;oll SUCH -10- 118
