• <br /> EXHIBIT B <br /> STATEMENT OF WORK <br /> To Interagency Agreement Dated 06/12/2012-Contract Routing Number 13 FEA 45806 <br /> These provisions are to be read and interpreted in conjunction with the provisions of the Interagency Agreement specified above. <br /> I. Project Description: <br /> This project is to replace the spillway at the Terrace Reservoir in the Rio Grande Basin. The Terrace Irrigation <br /> Company(TIC)owns and operates Terrace Reservoir. TIC utilize the reservoir for raw water storage of winter <br /> flows and peak runoff to supplement flows in the Alamosa River. In the early 1980's the State Engineer's Office <br /> (SEO)issued a gage height restriction on the reservoir due to inadequate size and the general condition of the <br /> dam's spillway. The restriction reduces the reservoir capacity by approximately 2,000 AF. Upon completion of <br /> the project the company will dedicate 2,000 AF of in stream flow storage as their contribution to the Alamosa <br /> River Instream Flow Project(ISF Project). <br /> The ISF Project is intended to restore flows and replace natural resources damaged by mining operations at the <br /> Summitville Mine in the upper Alamosa River watershed. Phase I includes purchasing senior irrigation water <br /> rights,transferring the rights to the Colorado Water Conservation Board(CWCB),changing the use in water court <br /> to ISF use by CWCB,and designing the spillway improvements. Phase II involves reconstructing the spillway <br /> (this project),storing the acquired rights,and the release of water to offset natural drop-offs in Alamosa River <br /> flows.Phase I of the Project is complete. <br /> This project will utilize Natural Resource Damage Settlement(NRDS)funds from both the State of Colorado and <br /> US Government.The US Department of the Interior has completed the electronic transfer of their share of NRDS <br /> funding to CDPHE for this project. CDPHE will reimburse CWCB for actual costs and expenditures up to the$2 <br /> million.CWCB will be managing this project and acting as the fiscal agent for all of the funding streams. <br /> The Resolution of the Trustees,and its extension resolution,naming this project is attached hereto as Attachment <br /> B-1 and incorporated by this reference. <br /> II. Performance Requirements/Deliverables: <br /> A. Task 1—Site Preparation <br /> The site preparation task encompasses all labor, materials, and equipment required for preparing the site <br /> for spillway construction. This task includes the mobilization of equipment, demolition of the existing <br /> spillway, installation of erosion and sediment control devices, clearing and grubbing, dewatering, <br /> excavation,and placement of fill materials. <br /> Method/Procedure <br /> Construction methods and procedures shall be in accordance with the final signed and sealed engineering <br /> project plans and specifications. All operations shall be performed following OSHA and all other local, <br /> State and Federal laws and regulations. <br /> Deliverable <br /> Signed and dated paper and electronic copies of As-Built drawings prepared by engineer of record on 11" <br /> x 17"sheet size. <br /> B. Task 2—Spillway Construction <br /> This task encompasses all labor, materials, and equipment required for the construction of the new <br /> spillway structure. This task includes foundation preparation; forming, reinforcement and placement of <br /> the concrete spillway structure; placement of instrumentation/monitoring devices; final grading and <br /> seeding;and construction management by the engineer of record. <br /> Page 1 of 4 <br /> Exhibit B-Statement of Work <br /> V 1/MAR2012 <br />
