17 <br /> APPENDIX 4 <br /> Tamarack Plan Operating Criteria <br /> The Tamarack Plan AOP will use the following criteria, summarized from Appendix A, Tab 3A to the <br /> Proposed Program: <br /> Periods of Surplus River Flows. If there is a Central Platte ESA Program that protects all existing and <br /> future water uses in Colorado, and Nebraska has taken adequate steps to adminster and augment its Platte <br /> Valley groundwater wells,the Tamarack Plan would define "Surplus River Flows" as the flows that exist <br /> when flows in the Platte River at Grand Island minus the then-existing flows in the river that are generated <br /> as a result of Recovery Program efforts equal or exceed the flow recommendations for that time as <br /> determined by the United States Fish and Wildlife Service (USFWS). If there is not an acceptable Program, <br /> "Surplus River Flows" will be considered to be any flows that would otherwise cross the state line and could <br /> be diverted and used in Colorado under the South Platte River Compact. <br /> If Surplus River Flows exist and additional depletions are not precluded by the South Platte Compact or <br /> water administration within Colorado,the first priority for the operation of the Tamarack Plan facilities will <br /> be to divert 30,000 acre feet of water(or that quantity of water otherwise found needed)that will produce <br /> 10,000 acre feet of return flows for Recovery Program purposes. The second priority will be to divert water <br /> for the purpose of generating recharge credits that will be assigned to the Water Administration Account and <br /> used for augmentation or other purposes. OM&R costs attributable on a pro rata basis to operations of the <br /> facilities during these periods for Recovery Program Account purposes will be paid by the State of Colorado <br /> from the operating funds allocated to the Tamarack Plan. OM&R costs attributable on a pro rata basis to <br /> operations of the facilities during these periods for Water Administration purposes will be covered by <br /> prepayments collected pursuant to 3.d. above, and paragraph 4.b. below. <br /> Periods of Shortage at Grand Island'. A Shortage Condition only exists under an acceptable ESA <br /> Program. Under this circumstance, the Tamarack AOP would consider a Shortage Condition to exist when <br /> flows in the Platte River at Grand Island minus the then-existing flows in the river that are generated as a <br /> result of Recovery Program efforts are less than the flow recommendations for that time as determined by <br /> the USFWS. During those periods when a Shortage Condition exists the facilities may be operated as <br /> directed by entities other than the State of Colorado, including GASP, LSPWCD, and others. The purpose <br /> of these operations is to accrue credits to the Water Administration Account. OM&R costs attributable on <br /> a pro rata basis to operations of the facilities during these periods for Water Administration purposes will be <br /> paid in advance by those entities requesting that the facilities be operated to accrue credits to the Water <br /> Administration Account. The facilities will be operated only to the extent directed and paid for by these <br /> This analysis assumes that Nebraska has implemented well regulations pursuant to the Cooperative <br /> Agreement,and that Colorado is obligated to consider flow targets in the operation of the Tamarack Plan. <br />
