• CDPHE reserves to itself and DOE the right to access the site in the event any <br /> remedial work needs to be done under TJMTRCA. <br /> CDPHE also reserves to itself and DOE the right to use the water right associated <br /> with the property (V.C.A.- Animas-La Plata Pipeline) as may be necessary toerform <br /> groundwater remediation and any other activities required by UMTRCA. p <br /> • The property may only be used for public purposes. <br /> • No well construction or use of groundwater is allowed without the written approval of <br /> CDPHE and DOE, <br /> • The land may only be sold or transferred to a governmental entity within the state. <br /> • Construction of any kind on the property will require the written approval of CDPHE <br /> and DOE. <br /> These restrictions have been previously discussed in "Property Rights Appraised" <br /> and will be considered further in "Easement Valuation". CDPHE then conveyed <br /> the property via Quit Claim Deed to CWCB on June 25, 1998 recorded on <br /> September 9, 1998 at Reception No. 753190. In Reception No. 753191, CWCB <br /> conveyed the property via Quit Claim Deed to the Animas-La Plata Water <br /> Conservancy District, the current owner of the fee simple estate. The conveyance <br /> to the District was subject to "a perpetual easement over that portion of the <br /> property reasonably necessary for the construction, operation, maintenance and <br /> replacement of the Durango Pumping Plant of the Animas-La Plata Project". <br /> CWCB assigned the perpetual easement to the United State of America Bureau of <br /> Reclamation on March 31, 2016. The value of Reclamation's interest in the <br /> Relinquishment Areas is the purpose of this appraisal. <br /> 60 <br />
