responsibility shall be to enforce the requirements of the plans and specifications
that have been approved by the Borrower. The Borrower shall be responsible for
review and approval of the construction firm(s) critical path schedule, and will submit
to the CWCB or make available for the CWCB's inspection at BORROWER'S office
the approved schedule and projections for monthly payments for each project.
i. CWCB shall have access to and/or receive copies as requested of contracts related
to the project, monthly reports, and other project-related documents. CWCB staff
shall have access to the site as needed.

k. Upon completion of the PROJECT construction, the BORROWER sha final
inspection for the CWCB staff to review the project and discuss any r ' ing
issues prior to Project Completion.
I. The BORROWER shall pay all of the expenses related to the PROJECT when such bills
are due.
2. ELIGIBLE EXPENSES. The following items are eligible for loan disbursements.
a. Preparing final designs and specifications for the PROJECT.
b. Preparing bid and construction contract documents.
c. Preparing environmental assessment or environmental impact statements, and
otherwise complying with the Federal National Environmental Policy Act.
d. Complying with all federal, state, and local regulatory requirements, including the
obtaining of all required permits.
e. Fish and wildlife mitigation measures required by federal, state, or local laws and
regulations.
f. Actual construction as called for in the design documents and in change orders
approved by the BORROWER and available for inspection by the CWCB.
g. Engineering services for construction management, including design and
construction management for change orders available for inspection by the CWCB.
h. Interest during completion of the PROJECT pursuant to Paragraph A.4 of the
Contract.
i. Legal services for reviewing engineering services contracts, reviewing this Contract,
reviewing construction Contract documents, and for complying with all federal, state,
and local regulatory requirements.
j. PROJECT-related expenses incurred prior to the Effective Date of this Contract in
Loan Contract C150243
