DEPARTMENT OR AGENCY NUMBER <br /> CDBG 89-617 320000 <br /> CONTRACT ROUTING NUMBER <br /> 6 (' 8 9( Z / <br /> FIRST AMENDMENT <br /> CONTRACT <br /> THIS CONTRACT, made this day /4-;/..._4_ -- , 1990,-by and between the State of <br /> Colorado for the use and benefit of the epartmerit of Local Affairs. 1313 Sherman Street, Denver, <br /> Colorado 80203 , hereinafter referred to as the State, and the Town of Crook, P. O. Box 158. <br /> Crook, Colorado 80726 , hereinafter referred to as the Contractor. , -, <br /> WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise <br /> made available and a sufficient unencumbered balance thereof remains available for payment in Fund <br /> Number 100- , aunt-Nt be 7 , Contract Encumbrance Number fre5gi,i7 ; and <br /> G API's COUr !A /a.! <br /> WHEREAS, required approval, clearance and coordination has been accomplished from and with <br /> appropriate agencies; and <br /> WHEREAS, the parties hereto have entered into a Contract dated August 15, 1989, with Contract <br /> Routing Number 89-617, and Contract Encumbrance Number C859617, hereinafter called the Original <br /> Contract, for the expenditure of Community Development Block Grant (CDBG) funds to construct flood <br /> control improvements for the Town of Crook, Colorado; and <br /> WHEREAS, final design and review by the Colorado Department of Highways of the Project to be <br /> constructed under the Original Contract has resulted in a determination that excavation of the drainage ditch <br /> running north and west of the town should be extended an additional 4,000 linear feet; and <br /> WHEREAS, the material excavated from the drainage ditch will be used to complete a section of the <br /> Contractor's flood control levee project along the South Platte River; and <br /> WHEREAS, in order to accomplish the additional Project work,the Contractor has requested and the <br /> State has approved supplemental CDBG funds for the Project in the amount of$135,000; <br /> NOW THEREFORE it is hereby agreed that: <br /> 1. The Original Contract be amended in the following manner: <br /> a. The amount of compensation shown in Paragraph 11 on page 3 of 12 pages of the main body <br /> of the Original Contract be amended to read: <br /> " TWO HUNDRED THIRTY THOUSAND AND NO/100 DOLLARS ($230,000.00 ) ." <br /> 2. The scope of services, Exhibit A to the Original Contract, be amended as follows: <br /> a. Item A. under "I. Scope of Services" on page 1 of 2 pages be amended to read: <br /> "A. The excavation of approximately 14,000 linear feet of the North Drainage Channel" <br /> b. Under"I. Scope of Services" on page 1 of 2 pages, the following paragraph be inserted after <br /> the third paragraph ending, " . . . meeting the Contractor's specifications": <br /> "At the completion of the Project the Contractor will provide the State with a copy of <br /> its maintenance manual describing the steps to be taken and the schedule to be <br /> followed in maintaining the Contractor's flood drainage system. The maintenance <br /> manual will be submitted to the State when the final payment of Contract funds is <br /> requested." <br /> Page 1 of 4 pages <br />
