c. The Hearing Coordinator shall set timelines and deadlines for all written submissions and <br /> shall determine order of testimony. <br /> d. Any Party may present testimony or offer other evidence as to whether the RICD should <br /> be granted, granted with conditions or denied. <br /> e. The Public Hearing may be recorded by a reporter or by an electronic recording device. <br /> Any Party requesting a transcription of the hearing shall be responsible for the cost of the <br /> transcription. <br /> f. The Colorado Rules of evidence shall not apply but the Board reserves the right to <br /> prevent redundant or irrelevant testimony. <br /> g. The Board may take final action at the hearing(s) or continue the hearing and/or <br /> deliberations to a date certain. <br /> RULE 12. SUBMISSION OF FINDINGS AND RECOMMENDATION TO THE WATER COURT <br /> The Board shall submit its Findings of Fact and final Recommendation to the water court within <br /> 90 days after the final closing date for filing statements of opposition. At the Public Hearing, if <br /> one has been requested, or at a regularly scheduled meeting of the Board, the Board shall <br /> deliberate and prepare Findings of Fact and Recommendation for each of the Evaluation Factors <br /> and a recommendation as to whether the Application should be approved, approved with <br /> conditions, or denied. The Findings of Fact and Recommendation shall be based on the Staff's <br /> proposed Findings of Fact and Recommendation,public comments, and testimony and evidence <br /> received at the Public Hearing, if such hearing was held. <br /> C:\2001 General\Rules-alt process.doc <br /> 6 <br />
