The water right decree for the Anaconda Ditch is valid and enforceable and the water <br /> rights have not been abandoned, in whole or in part. <br /> 5. There are no unquantified senior claims to water that would materially diminish the priority <br /> of the water rights. <br /> 6. The HRS report and conclusions were accepted at face value as requested by the client. <br /> We made no judgments or conclusions about the likelihood of obtaining a final decree that <br /> results in water yields equivalent to those presented in the HRS report. <br /> This letter report is subject to the following contingent conditions: <br /> 1. The information furnished by others is believed to be reliable. However, no warranty is <br /> given for its accuracy. <br /> 2. The location map in this letter report is included only to assist the reader in visualizing the <br /> property. <br /> 3. It is assumed that there are no hidden or inapparent conditions of the water rights that <br /> render them more or less valuable. No responsibility is assumed for such conditions or for <br /> arranging for engineering and legal investigations that may be required to discover them. <br /> 4. It is assumed that there is full compliance with all applicable federal, state, and local <br /> regulations and laws unless noncompliance is stated, defined, and considered in this letter <br /> report. <br /> 5. It is assumed that all required permits or other legislative or administrative authority from <br /> local, state,or national government or private entity or organization have been or can be <br /> obtained or renewed for the use on which the value estimate contained in this letter report <br /> is based. <br /> 6. We reserve the right to alter statements, analysis, conclusions, or any value estimate in <br /> the appraisal if there become facts known pertinent to the appraisal process which were <br /> unknown at the time of the report preparation. <br /> 7. The value as presented in this letter report is based on the current administration of the <br /> water rights in Colorado, and in particular Water Division No 3.Any material change of the <br /> present administration could substantially affect the value at present for better or worse. <br /> Description of the Anaconda Ditch <br /> The Anaconda Ditch diverts from the Rio Grande in the SW%SE% of sec. 25, T. 40 N., <br /> R. 3 E., N.M. P.M., about 2 miles east of the town of South Fork. The ditch runs easterly about <br /> 5.25 miles and delivers water to the River Island Ranch and the Nickerson Ranch. The HRS <br /> report describes the historical operation of the Anaconda Ditch and use on the River Island Ranch <br /> and quantifies the historical consumptive use associated with the direct flow diversions by the <br /> Anaconda Ditch for the River Island Ranch. Figure 1 displays the location of the ditch and other <br /> pertinent features: <br />
