It is understood that the San Luis <br /> Valley Water Conservancy District (SLVWCD) is considering the acquisition of the water rights <br /> from Rio Grande Ranch, LLC and would use the water rights in connection with their <br /> Augmentation Program. This investigation was conducted and the report was prepared by Frank <br /> Healy and Tom Williamsen. <br /> During the course of this investigation, we conferred with Mike Gibson, manager of <br /> SLVWCD; Tod Smith, attorney for SLVWCD; Ben Cannon, Water Commissioner in Water District <br /> No. 20; Steven Jeffers, attorney for Penrose Water District; Gary Thompson, consulting engineer <br /> with W.W. Wheeler and Associates, inc.; Ivan Walter, consulting engineer; and Grady McNeil, <br /> Colorado Division of Wildlife. We reviewed the report.provided by Mike Gibson entitled "Historical <br /> Consumptive Use Analysis for the Anaconda Ditch and Pfeiffer Ditch Water Rights Used on,the <br /> River Island Ranch" prepared by HRS Water Consultants, Inc. (HRS) for Rio Grande Ranch, LLC <br /> in August 2006. We also reviewed our company files with regard to information about certain <br /> water right transactions and administration practices in the Rio Grande basin. We did not visit the <br /> Anaconda Ditch. <br /> The Pfeiffer Ditch included in the HRS study is not part of the possible acquisition of water <br /> rights by SLVWCD and is not included in this appraisal. Also, the Shaw Reservoir water rights <br /> diverted by the Anaconda Ditch were not included in the HRS analysis as these rights were not <br /> acquired from the prior owners by Rio Grande Ranch, LLC and are not part of the possible <br /> acquisition by SLVWCD. <br /> Assumptions and Limiting Conditions <br /> In this effort, we assumed that: <br /> 1. The legal descriptions furnished are correct. <br /> 2. The title to the water rights is good and marketable unless otherwise stated. <br /> 3. The water rights are free and clear of any or all liens or encumbrances unless otherwise <br /> stated. <br />
