Johnson,LLC <br /> MEMORANDUM <br /> TO: SPWRAP Board & Membership <br /> FR: Austin Hamre <br /> DT: October 14, 2014 <br /> RE: Board Actions and Other Legal Issues Since Last Annual Meeting <br /> The following summarizes the actions taken by the Board since the 2013 annual meeting, and <br /> other legal issues that have been discussed but not yet resolved: <br /> 1. Class I-2 and I-3 Memberships: SPWRAP completed the formulation and adoption of <br /> these classes of memberships for entities involved in drilling and hydraulic fracturing <br /> (fracking) of O&G wells where a federal nexus exists. Due to circumstances unique to <br /> the North Platte Basin in Colorado, a slightly different process was adopted for activities <br /> in the South Platte and North Platte Basins. <br /> 2. SPWRAP Executive Director: SPWRAP finalized the description of the roles and <br /> responsibilities of its executive director. <br /> 3. South Platte Lower River Group (SPLRG) Dissolution: Created in the late 1990s, <br /> SPLRG began doing some of the tasks related to recharge projects that were later <br /> assumed by SPWRAP. It also provided a forum for dialogue between lower river water <br /> users, State government, and other Colorado stakeholders in PRRIP. Following the <br /> creation of SPWRAP, SPLRG became inactive, and after some discussion over the last <br /> year, it was decided that maintaining both entities was not necessary. Dissolution of the <br /> SPLRG corporate structure became effective at the end of August, 2014, and to the extent <br /> necessary, SPWRAP will take on the functions previously served by SPLRG. <br /> 4. Recharge Projects: Despite a desire to find a recharge project to take the place of the <br /> Winterhaven Project on which the parties were never able to reach agreement, no new <br /> recharge projects were pursued in the last year due largely to the flooding that occurred in <br />
