Andress <br /> Ratify Proposed Statement of Opposition <br /> The applicant is developing a subdivision approximately one <br /> mile southeast of the Town of Crested Butte (See attached map) . <br /> It consists of 14 duplexes and seven single family residential <br /> units. Uses will include both in-house domestic and lawn and <br /> garden irrigation. Diversions will occur from the Slate River via <br /> both a well and a ditch. Sewage return flows will be via the <br /> central system of the Skyland Metropolitan District to the East <br /> River, above its confluence with the Slate River. The applicant <br /> has filed this as a Plan for Augmentation, though the <br /> appropriation date claimed for all structures is July 20, 1984. <br /> The Board holds an appropriation for instream flow on the <br /> Slate River for 23 cfs from Coal Creek to the East River. The <br /> appropriation was made on March 17, 1980. All opposition has <br /> withdrawn from the case and a decree is expected shortly. <br /> The potential for injury comes from the applicant ' s request <br /> for approval to divert out-of-priority. The applicant plans to <br /> construct a pond of 3.2 acre-feet capacity which would fill under <br /> the July 20, 1984 priority. Assuming the pond fills during the <br /> runoff season with its 1984 priority, releases from the pond would <br /> then be used to augment those out-of-priority diversions from the <br /> well. However, because the in-house wastewater will enter a sewer <br /> system which discharges to the East River, such use is 100% <br /> consumptive so far as the instream flow appropriation on the Slate <br /> River is concerned. This amounts to a depletion of 14.4 acre-feet <br /> annually from the Slate River . The proposed augmentation pond is <br /> not large enough to make up such depletions. The applicant sized <br /> the pond to replace only the in-house consumptive use. <br /> 716 <br /> case/and <br />
