has ruled that the Corps does have that authority. Mr. Woodard 111 pointed out that the U.S . Solicitor General in recent statements <br /> had stressed the importance of cooperative federalism. In <br /> following up on these statements, Mr. Woodard wrote to the U.S. <br /> Solicitor, indicating that Colorado was ready to take him up on <br /> this cooperative approach and that the U.S. should recognize the <br /> 1977 amendment to the Clean Water Act which presumably removed <br /> the Corps ' authority in projects such as Wildcat Reservoir. <br /> Mr. Woodard expressed hope that the contacts he made may be <br /> helpful and both the State and Federal agencies should act in <br /> concert in resolving this issue. <br /> In his report on possible litigation with Kansas on the <br /> Arkansas River, Mr. Woodard stated that over the last couple of <br /> years, Kansas has alleged that Colorado was not operating the <br /> Trinidad and Pueblo Reservoirs in compliance with the Arkansas <br /> River Compact. After much correspondence and discussions at <br /> Arkansas River Compact Administration meetings, Kansas has failed <br /> to show how Colorado is depleting the River contrary to compact <br /> requirements . Kansas ' actions and allegations resulted in a <br /> meeting last fall during which testimony was given by Colorado, <br /> the Bureau of Reclamation and the Corps of Engineers . Kansas <br /> abstained from presenting any testimony. Mr. Woodard expects <br /> that Kansas will be taking further action leading to possible <br /> litigation this fall . To react to this possibility Mr. Woodard <br /> has contacted the leadership of the General Assembly and the <br /> Joint Budget Committee concerning possible need for funds for <br /> such litigation in the event it goes forward. <br /> Agenda Item 6 - State Engineer 's Report <br /> Mr. Jeris Danielson, State Engineer, was unable to attend <br /> the meeting, therefore his report was omitted. <br /> Agenda Item 7 - Development Authority' s Report <br /> Mr. Ival Goslin, Executive Director of the Authority stated <br /> that he had no report to present. <br /> Agenda Item 8 - Floodplain Resolutions <br /> Staff member, Larry Lang, briefly summarized the several <br /> flood insurance studies, flood hazard area delineations, and one <br /> floodplain management study being presented for Board action <br /> (Appendix C attached) . Mr. Johnston moved, seconded by Mr. <br /> Kroeger that the several resolutions pertaining to the flood <br /> studies described in Agenda Item 8 be approved. The motion was <br /> adopted by unanimous voice vote. <br /> Agenda Item 9 - Review of Wild and Scenic River Studies (No Board <br /> action to be taken) <br /> • <br /> -10- <br />
