R E S O L U T I 0 N
WHEREAS, the United States Army Corps of Engineers,
Omaha District, completed in January, 1966, a Flood Plain Informa-
tion Report entitled "Flood Plain Information, Volume III, Metro-
politan Region, Denver, Colorado, " which includes Clear Creek; and
WHEREAS, the Colorado Water Conservation Board, as
requested by the Inter-County Regional Planning Commission by
Resolution Number 1, adopted December 13, 1967, approved and
designated the floodplains described in the said report; and
WHEREAS, a new report entitled "Flood Hazard Area
Delineation, Clear Creek, Adams County and Jefferson County,
Colorado, " dated November, 1979, has been prepared by Gingery
Associates, Inc. , at the request of the Urban Drainage and Flood
Control District, which report updates and revises the previous
information for Clear Creek as prepared by the Corps of Engineers;
and
WHEREAS, said report describes and outlines the floodplain
data and information for the storm and floodwater runoff channels
or basins of the study area; and
WHEREAS, the Urban Drainage and Flood Control District
has requested the Colorado Water Conservation Board to designate
and approve the floodplain areas as set forth in the aforesaid
report; and
WHEREAS, Section 37-60-106 (1) , Colorado Revised Statutes
1973, requires the Colorado Water Conservation Board to assist in
the prevention of floods and flood damages therefrom; and
WHEREAS, Sections 31-23-201 and 30-28-111, Colorado
Revised Statutes 1973, provide that such legislative bodies of
local jurisdictions may provide zoning regulations for land uses
on or along any storm or floodwater runoff channel or basin only
after designation and approval by the Colorado Water Conservation
Board; and
WHEREAS, Section 37-60-106 (1) (c) , Colorado Revised
Statutes 1973, directs the Colorado Water Conservation Board to
designate and approve storm or floodwater runoff channels or basins
and to make such designations available to legislative bodies of
local jurisdictions; and
