Mr. Scott Balcomb, attorney for the Ute Water <br /> Conservancy District, requested that the filings for Plateau <br /> Creek be delayed until his client could negotiate with the CWCB <br /> staff. <br /> Mr. Johnston moved, seconded by Mr. Meyring, that <br /> the recommended instream flows on Mesa Creek be filed and that <br /> the filings on Plateau Creek be reconsidered at the March 1986 <br /> meeting. The motion was adopted by a vote of 7 to 2 , with Mr. <br /> Lochhead abstaining. <br /> (4) Roaring Fork River and Cattle Creek <br /> Mr. Johnston moved, seconded by Mr. Smith, that the <br /> recommended instream flow filings on the Roaring Fork River and <br /> Cattle Creek be approved. The motion was adopted unanimously. <br /> c. Ratification of Statements of Opposition (Appendix Y) <br /> ( 1 ) Case No. 185CS229--Double JK Ranch <br /> (2) Case No. 185--Vajradhatu <br /> Mr. Johnston moved, seconded by Mr. Getches, that the <br /> Statements of Opposition filed on behalf of the Board for the <br /> above-listed cases be ratified. The motion was adopted <br /> unanimously. <br /> d. Ratification of Stipulations <br /> ( 1 ) Case No. 84CW659--Red Mountain Ranch <br /> Mr. Johnson moved, seconded by Mr. Smith, that the Board <br /> approve the proposed stipulation between the Board and the Red <br /> Mountain Ranch. The motion was adopted unanimously, with Mr. <br /> Lochhead abstaining. <br /> e. Settlement of Hermosa Creek Case <br /> Melinda Kassen, Assistant Attorney General, reported <br /> that the Hermosa Creek trial date had been vacated pending <br /> settlement negotiations. <br /> f. Settlement of Priest Gulch Case <br /> Ms. Kassen reported that the Priest Gulch case had been <br /> settled and the statement of opposition filed against the Board <br /> had been withdrawn. <br /> g. Vail Valley Consolidated Water District Case (Appendix <br /> Z) <br /> In summarizing this item, Mr. McDonald stated that he had, <br /> as directed at the September meeting, forwarded a letter to the <br /> -13- <br />
