William McDonald, Director <br /> SUBJECT: Agenda Item No. 4, December 5, 1979 Board Meeting <br /> (Policy Regarding Reimbursement for Flood Control <br /> and Recreation Projects) _ <br /> 1. S .B. 537, enacted in 1579 by the Colorado General Assembly, amended <br /> 37-60-119, C.R.S. (1973) , to include flood control projects among <br /> those which could be constructed by the Board. In addition, this <br /> bill authorized the construction of the recreational facilities <br /> associated with any Board projects . Finally, the bill specified <br /> that "all or any portion of the costs attributable to flood <br /> control and recreation may be considered nonreimbursable at; the <br /> discretion of the board . . •" (subject, of course., to the le gis.- <br /> lature 's approval when it authorizes a project) . <br /> 2. As you are aware, 37-60-119 requires that the Board recover its <br /> capital investment on projects serving all other purposes . Thus, <br /> the question before the Board is whether it would like to exercise <br /> its newly vested discretion on flood ,control and recreation proj . <br /> ects (and if so, pursuant to some evaluation criteria to be <br /> developed) or simply require, as it has with water supply projects , <br /> that its capital investment also be recovered in full in the case <br /> of flood control and recreation projects. <br /> I/ <br /> 3. Staff recommendation. <br /> A. The staff recommends that the Board adopt the policy of <br /> recovering in full the capital investment which it makes in <br /> flood control and recreation projects (plus a service charge <br /> of 2 percent--see agenda item 3) . <br /> B. The staff further recommends that the Board adopt a policy <br />
