A <br /> subsequent meeting has been scheduled to present this proposal • <br /> to the Board staff, the State Engineer, and local water-user and <br /> development entities in the South Platte River Basin. <br /> 7. EPA ground water strategy <br /> Mr. McDonald reported that, after several years of <br /> effort, the EPA recently released a draft copy of "A Ground Water <br /> Protection Strategy" for review and comment. Although this <br /> strategy deals largely with water quality issues, Mr. McDonald <br /> suggested that the Board may wish to have the staff review the <br /> report and present a summary to the Board at its March meeting. <br /> Comments on the draft are due March 23, 1984.. <br /> Mr. Johnston moved, seconded by Mr. Woodard, that a <br /> discussion of the draft report be included in the March Board <br /> meeting. The motion was approved by unanimous voice vote. <br /> Agenda Item 5 - State Engineer's Report <br /> Due to previous commitments, State Engineer Jeris Danielson <br /> was unable to attend .the morning session, hence no report was <br /> presented. <br /> Agenda Item 6 Attorney General' s Report <br /> Mr. Woodard reported on two items, namely: • <br /> 1. Riverside v. Stipo case <br /> Mr. Woodard; referred to his report presented at the <br /> January 1984 Board meeting in which he stated that he had written <br /> to the U. S. Solicitor General, Rex Lee, asking that the Depart- <br /> ment of Justice rethink the position taken by the Corps of <br /> Engineers with reference to the Riverside case. A response had <br /> been received from Mr. Lee which reiterated that the United States <br /> would continue its involvement in the Riverside case with refer- <br /> ence to the 404 permit. Mr. Lee, however, was receptive to a <br /> meeting to discuss this issue further. Mr. W_ooda:rd indicated <br /> that he would try to arrange such a meeting in Washington within <br /> the next two months. In the meantime, Mr. Woodard plans to meet <br /> with the water users to develop strategy for the meeting. Further- <br /> more, he suggested that Board members and water-user entities <br /> apprise him of other water-related issues which should be addressed <br /> at the upcoming meeting. <br /> 2. Reserved rights litigation fund <br /> Mr. Woodard reported that, during the week preceding the <br /> Board meeting, the General Assembly notified him and the Governor' s <br /> office that the $4.2 million that is still remaining from the <br /> reserved rights litigation fund, which was established two years • <br /> -4- <br />
