Colorado will not agree to operations which result in . <br /> amounts of vacant space in excess of the 5 . 35 -maf required by the <br /> flood control regulations for Hoover Dam on January 1 , 1985 , <br /> absent a showing either that the unique spillway and flood damage <br /> problems of 1983 justify the same or that the analyses in the <br /> 1982 Corps of Engineers ' report on Hoover Dam flood control are <br /> in error and require modification. We note in particular that <br /> the Corps ' report was prompted by the recognition that the <br /> reservoir system had filled and that the Central Arizona Project <br /> was not yet diverting water. Yet that report, after a very <br /> careful and fully documented analysis , concluded that 5.35 maf of <br /> vacant space on January 1 yielded the optimum operating <br /> condition. <br /> With respect to the study plan, we are concerned that it has <br /> been developed without input from the basin states and has <br /> already been initiated. It would not seem prudent to proceed <br /> further without affording the seven basin states an opportunity <br /> to meet with the Bureau and discuss the purposes, scope, and <br /> direction of the study. <br /> In particular, consideration needs to be given to how to <br /> handle differences of opinion in interpretation of the various <br /> documents which are commonly referred to as the "Law of the <br /> River. " Also, we have substantial concerns about how the results <br /> of the study might be used in making future determinations of <br /> 602 (a) storage requirements and reservoir operations .
