Mr. McDonald recommended that the District 's problem involved • <br /> a privileged attorney-client relationship (Attorney General ' s <br /> Office and the District) and that this item be discussed during <br /> an executive session over the lunch hour. Mr. Paddock agreed to <br /> Mr. McDonald' s recommendation. Mr. Johnston moved, seconded by <br /> Mr. Kroeger, that the Board discuss this matter in executive <br /> session. Motion approved unanimously. <br /> At this point in the proceedings, Chairman Vandemoer <br /> adjourned the meeting at 11 :50 a.m. and announced that the meeting <br /> would reconvene at 1 .45 p.m. <br /> Chairman Vandemoer called the afternoon session to order at <br /> 2:05 p.m. <br /> Mr. McDonald reporting on the executive session stated that <br /> the Board directed the staff to continue its consultations with <br /> the District and the Attorney General ' s Office to reach an <br /> acceptable solution to the District ' s problems . <br /> Agenda Item 13 - Colorado Salinity <br /> a. Status of Legislation <br /> Mr. McDonald reported that "mark-up" of S. 752 should be held <br /> within the next four weeks. However, a hearing date had not been <br /> set for the House version, H. R. 2790. Congressman Kogovsek has <br /> been working very hard to get a hearing on H.R. 2790 but, to date, <br /> has been unsuccessful. <br /> b. Review of Salinity Control Forum' s Draft Triennial <br /> Report. <br /> Mr. McDonald reported that the Salinity Control Forum Work <br /> Group met on March 6 and 7, 1984, and edited a preliminary draft <br /> of the 1984 report. No major issues arose during those <br /> discussions (Appendix I attached) . <br /> Agenda Item 14 - Colorado River Endangered Fish Species <br /> Mr. McDonald briefly discussed his March 8, 1984, memo to the <br /> Board concerning the consultation, exemption, and listing <br /> processes for endangered species. He then introduced Mr. Galen <br /> Buterbaugh, Regional Director of the U. S. Fish and Wildlife <br /> Service. Mr. Buterbaugh briefly reviewed the history of the <br /> studies concerning the endangered fish. He introduced Mr. Frank <br /> Dunkle, Mr. John Green, and Mr. Don Archer, who are on his staff <br /> and are working on the endangered fish program. Mr. Archer then <br /> gave a slide presentation covering the Colorado Squawfish, Boney <br /> Tail Chub, Humpback Chub, and the Humpback Sucker (currently not <br /> listed as endangered) . He discussed the areas of study and the <br /> impacts of water development on the habitat for the fish in the • <br /> Colorado River (Appendix J attached) . <br /> -12- <br />
