( 3) We thought the responsibility for constructing the •
facilities, and the process involved, needed to be
clarified . Language was included to accomplish this.
(4) We thought the repayment provisions needed to be clarified .
Appropriate _language was drafted.
( 5) Since it is likely that something less than the Bureau' s
previously prepared full development plan will be
implemented, language was suggested to accommodate this
possibility and to comply with the Board' s March directions
to me (cited above) .
(6) We suggested new language which would condition the State' s
performance upon the availability of water and of future
state appropriations as required by the Board' s action at
its October, 1982 , meeting (see my September 30, 1982 , memo
to the Board) .
These proposed revisions were subsequently transmitted to
the Attorney General 's office for review. Several wording
changes were suggested by that office. These suggested changes
were in turn transmitted to the Bureau on August 9 for review by
the Bureau staff and the Department of the Interior' s
Solicitor 's office in Amarillo. We have yet to hear back.
I expect to be able to complete the contract within the next
few weeks. The Board will be advised if any issues arise which
need your attention.
JWM/bm
•
MEMORANDUM -2- August 31, 1983
