Flow Program, Ratify Change in Board Application for
Water Right
Water Division 2
Case No. 2-82CW138, Grape Creek from DeWeese Reservoir to
DeWeese-Dye Ditch Headgate.
On June 3 , 1982 , the Board approved a final recommendation
for an instream flow appropriation on the above referenced
segment of Grape Creek . The application for this water right was
filed with the court. As a result of resume publication, state-
ments of opposition were filed by the Upper Arkansas Water
Conservancy District and the DeWeese-Dye Ditch and Reservoir
Company.
Meetings have been held with these parties to discuss their
objections, which centered around the issue of water avail-
ability. As a result of these meetings a re-evaluation of the
availability of water was made. Additional data examined
included stream gaging records, diversion records, reservoir
storage records, fisheries data, etc. Meetings were then held
with the Division of Wildlife, the Bureau of Land Mangement, and
the Division Engineer ' s Office to discuss these additional data.
As a result of this re-evaluation, the staff has determined
that sufficient water is not available for this appropriation.
