known as the South Boulder Canon Ditch, said headgate being located at
a point on the easterly bank of South Boulder Creek in the SE 1/4 of
the SE 1/4 of Section 9, Township 1 South, Range 70 West of the 6th
P.M. , in Boulder County, Colorado, approximately 170 feet North and
350 feet West of the SE corner of said Section 9. The Applicant shall
leave 10% of its pro rata share of total diversions in the Leyner
Cottonwood Ditch to compensate shareholders for carrying and return
flow losses. The Applicant shall abandon the remaining 30% portion of
the Leyner Cottonwood Decrees to the stream to compensate any other
vested appropriators on South Boulder Creek and Dry Creek for changes
in these decreed rights. At no time shall the Applicant divert more
than 60% of its pro rata share in and to 3.64% of the original Leyner.
Cottonwood Decrees then physically and legally available at the Leyner
Cottonwood Consolidated Ditch Co. 's headgate, but for this transfer or
other transfers from the ditch.
b. After the change herein decreed, the amounts transferred to
the South Boulder Canyon, left in the Leyner Cottonwood, abandoned,
and remaining at the original headgate (except for any transfers in
other approved Court decrees) are as follows:

c. In order to prevent material injury to other users of vested
water rights, including other users of vested water rights in the
Leyner Cottonwood Consolidated Ditch Co., the parties hereto have
agreed that Applicant's diversion of the Leyner Cottonwood
