known as the South Boulder Canon Ditch, said headgate being located at <br /> a point on the easterly bank of South Boulder Creek in the SE 1/4 of <br /> the SE 1/4 of Section 9, Township 1 South, Range 70 West of the 6th <br /> P.M. , in Boulder County, Colorado, approximately 170 feet North and <br /> 350 feet West of the SE corner of said Section 9. The Applicant shall <br /> leave 10% of its pro rata share of total diversions in the Leyner <br /> Cottonwood Ditch to compensate shareholders for carrying and return <br /> flow losses. The Applicant shall abandon the remaining 30% portion of <br /> the Leyner Cottonwood Decrees to the stream to compensate any other <br /> vested appropriators on South Boulder Creek and Dry Creek for changes <br /> in these decreed rights. At no time shall the Applicant divert more <br /> than 60% of its pro rata share in and to 3.64% of the original Leyner. <br /> Cottonwood Decrees then physically and legally available at the Leyner <br /> Cottonwood Consolidated Ditch Co. 's headgate, but for this transfer or <br /> other transfers from the ditch. <br /> b.
