DISTRICT COURT, WATER DIVISION NO. 1, STATE OF COLORADO <br /> Case No. 82-CW-052 <br /> FINDINGS AND RULING OF REFEREE <br /> IN THE MATTER OF THE APPLICATION OF THE TOWN OF ERIE FOR WATER RIGHTS <br /> IN BOULDER AND WELD COUNTIES <br /> THIS MATTER having been considered by the Referee, he hereby <br /> finds: <br /> FINDINGS OF FACT AND CONCLUSIONS OF LAW <br /> 1. An Application for an Alternate Point of Diversion and Change <br /> of Use was filed by the Town of Erie with the Water Clerk of Water <br /> Division No. 1 on February 26th, 1982; an Amendment thereto was filed <br /> on December 20th, 1982. The applicant has hereby withdrawn its claim <br /> for an alternate point of diversion. <br /> 2. All notices required by law for the filing of the Application <br /> have been fulfilled. The Referee has jurisdiction over the subject <br /> matter of this proceeding and the parties affected hereby, whether <br /> they have appeared or not. <br /> 3. Statements of Opposition were timely filed by The City of <br /> Boulder; The Colorado Water Conservation Board; The City and County of <br /> Denver, acting by and through its Board of Water Commissioners; The <br /> City of Lafayette; The City of Louisville; Public Service Company of <br /> Colorado; and The Water Users Association of District No. 6. These <br /> parties, by their attorneys, have approved this Ruling as indicated b <br /> 9 by <br /> their signatures on counterparts hereof, and withdrawn their <br /> Statements of Opposition with the understanding that such withdrawal <br /> is conditioned upon a Decree pursuant hereto being signed without <br /> changes, and with the further understanding that the parties have not <br /> 1 <br />
