7. Existing uses or exchanges of water in existence
on the date of a2Qroariation : Pursuant to C.R.S. 19731
37-92-102( 3) ( b) the appropriation and water right of the
applicant herein confirmed by decree shall be subject to
the uses or exchanges of water being made by other water
users pursuant to appropriation or practices in existence
on the date of appropriation referred to in paragraph 4
above, whether or not previously confirmed by court order
or decree to the extent that such uses or exchanges have
occurred. Specifically, but without limiting the above ,
this water right is subject to the following: a ) the prac -
tice of FRICD storing water by agreement with Denver in
Gross Reservoir during the winter months when climatic condi-
tions make it difficult to divert water into and carry water
in the Community Ditch in an amount not exceeding the his-
torical practice and b) any uses or exchanges of water by
the City of Lafayette made pursuant to the decrees granted
in Case Nos. 8346, 8347, and 8348, Water Division No. 1.
8. Subject to agreement with Denver: The appli -
cant ' s rights are subject to the senior rights of the City
and County of Denver in the subject source. The applicant
recognizes that Gross Reservoir and South Boulder Diversion
Dam above Eldorado Springs, owned by the City And County of
Denver, have been and will in the future be used in exchanges
for water diverted under its adjudicated water rights. The
Colorado Water Conservation Board hereby agrees that it
will not exercise its water rights, herein, in the South
Boulder Creek between Gross Reservoir and Eldorado Springs
in such a manner as to impair such exchange operations by
the City and County of Denver.

80 CW 451 , Water Division No. 1 : If this court in Case No.
80 CW 451 , In the Matter of the Aealication for Water Rights
of the Ci tx • of Louisville decrees an exchange of a certain
amount of water with a priority date senior to this water
right, then the exchange of that amount of water shall be
administered as being senior to this water right.
