The first is section 1-B, Publio Law 534, 78th <br /> Congress Second Session, being the Flood Control Act ap- <br /> proved December 22, 1944, and it reads : "The use for 0 <br /> navagation, in connection with the operation and mainten- <br /> anae of such works herein authorized for construction, of <br /> waters arising in states lying wholly or partly west of the N, <br /> ninety-eighth meridian shall be only such use. as not eon.. <br /> Eliot with any beneficial or consumptive use, present or <br /> future, in states lying wholly or partly west of the ninety- <br /> eighth meridian of such waters for domestic, municipal, stock <br /> water, irrigation, mining or industrial purposes. " <br /> I read or paraphrase section 1-8, Public Law 14, <br /> 79th Congress, first session, being the River and Harbor <br /> Aot approved March 2, 1945, in which the wording is identical <br /> with the section I have just read in full from the Act of <br /> 1944. <br /> I read from Public Law 526, 79th Congress, 2nd <br /> Session, an extract from the River and Harbor Act approved <br /> July 24, 1948, reading, "and provided further, that the word <br /> 'navigation' appearing in Paragraph (b) of Section 1 of the <br /> River and Harbor Act approved March 2, 1945, (Public Numbered <br /> 14, 79th Congress, First Session) shall in respect to the <br /> Arkansas River and tributaries include the use of water here- <br /> in referred to for power purposes. * <br /> we have for convenience only numbered the proposed <br />
